[Fox Business] Court ruled that COVID-19 is not an occupational hazard but a 'universal risk'

The Supreme Court on Thursday issued mixed rulings in a pair of cases challenging Biden administration COVID-19 vaccine mandates, allowing the requirement for certain health care workers to go into effect while blocking enforcement of a mandate for businesses with 100 or more employees.

The latter, an Occupational Safety and Health Administration rule that took effect on Monday, said that businesses with at least 100 employees needed to require workers to get vaccinated, or get tested weekly and wear a mask.

The Court ruled that OSHA lacked the authority to impose such a mandate because the law that created OSHA "empowers the Secretary to set workplace safety standards, not broad public health measures."

"Although COVID-19 is a risk that occurs in many workplaces, it is not an occupational hazard in most," the Court ruled. "COVID—19 can and does spread at home, in schools, during sporting events, and everywhere else that people gather. That kind of universal risk is no different from the day-to-day dangers that all face from crime, air pollution, or any number of communicable diseases."

#2  The mandate for health workers at facilities that take federal money can be worked around many ways. SCROTUS has signaled they do not wat to re-visit this. Because they know an argument that working for a federal contractor does not make you a federal employee will open up a dozen cans of worms.

Democrats have instructed black leaders to instruct black people that whatever the 80-year-old white racist said in his speech was a "good thing" and they should fully support it if they want "liberation and equality and all that stuff."

Republicans pounced on the speech, likely because they're racist.

Anti-piracy mission risks ejection from Somalia

[EU] anti-piracy mission risks losing permission to pursue pirates in Somalia's waters due to local politics, the Observer reports, in the latest dramatic development in the Horn of Africa nation.

In December 2021, Somalia's federal government agreed to extend a UN mandate for the EU operation, called Atalanta, for just three months. Somalia has a coastline of 3,333 kilometers.

And its future intentions were "rather ambivalent" and "to be doubted", according to an internal EU foreign-service paper, dated 5 January and seen by EUobserver.

Somalia's new "posture towards the international presence [is] ... to be seen in the context of [Somalia's] ongoing electoral process, notably increasing tensions and electoral fragmentation," the EU said.

And as they prepared for presidential elections "likely to take place in June", the Somalian powers that be wanted to make a point.

They wanted the EU or other "future partners to reinforce [the] Somali national coasties and navy", instead of policing the region.

They also wanted Atalanta to focus more on illegal fishing and toxic-waste dumping, amid "destabilizing information stating that the operation [Atalanta] 'protects the illegal fishing vessels," the EU foreign service said.

And they wanted the text of any long-term UN resolution "to notably reduce the perceived negative language towards Somalia".

If the current UN resolution expires in March, then there would "be no more legal basis for Atalanta to fight armed robbery in Somali territorial waters or on its territory, and ... to fight piracy off the coast of Somalia", the EU noted.

The EU mission could still fight pirates on the "high seas" and could still perform "secondary tasks", it said.

These include protecting food-aid ships, enforcing a UN arms embargo on Somalia, pursuing drugs traffickers, illegal fishing boats, and illicit charcoal traders.

But "capability ... to pursue pirates and armed robbers in Somali territorial waters remains indeed important for an effective counter-piracy mission. Ability to act on land would be even better," the EU foreign service said.

The EU planned to "increase pressure " on Somalia to get, at least, another nine-month extension. It also aimed to use other EU military assistance to Somalia's armed forces "as a political leverage".

And they are seeking to extend their presence, with pending accords on Atalanta anti-piracy operations also in the waters of Djibouti, Mauritius, and Seychelles, the EU internal paper indicated.

The developments come amid increased instability in the region caused by Æthiopia's civil war. They also come amid heightened geopolitical tension, as China and Russia compete with EU interests in Africa.

In the meantime, Somalia's formal position was that "piracy is no longer posing a significant threat to the regional peace and security," the EU report noted. But the EU concern over Atalanta's potential expulsion from the country's waters indicated that that was far from true.

At least 8 killed in a suicide car bomb attack in Somalia's capital
[Garowe] At least eight people have been confirmed dead in Mogadishu following a suicide explosion that targeted a convoy within the insecure capital, which has been witnessing several terrorism incidents in recent days.

Eyewitnesses said a jacket wallah driving in a car let 'er rip along the 21st October streets in Waberi district of the capital, just near the busy Aden Adde International Airport, further raising questions about the security of the capital.

Sources claimed the bomber targeted a convoy of "white officials" but their identity is yet to be established. There are several aid workers from foreign countries in Somalia, with some also attached to diplomatic missions.

UK Home Office backs down on Syrian asylum-seeker's case
[DW] In December, the Home Office sent a rejection letter to a Syrian asylum-seeker, saying it was safe for him to return. That would have been first case of its kind in the UK. Now, authorities appear to have backtracked.

The case concerns a 25-year-old Syrian man who came to the UK in May 2020. He reportedly evaded forced conscription into the army in 2017 to avoid being forced to kill fellow Syrians.

The man, who has not been named for his protection, has said returning to Syria would put his life in danger. He would be targeted as a draft dodger, arrested and possibly killed, he said.

In its rejection letter to the man, reported by The Guardian newspaper, the Home Office said he could safely return to Syria. "I am not satisfied to a reasonable degree of likelihood that you have a well-founded fear of persecution," the Home Office wrote, according to The Guardian.

In what appears to be a U-turn, the Home Office tweeted on Tuesday that "under the current circumstances we are not returning people to Syria. The UK government agrees with the UN judgement that Syria remains unsafe for them."

The Home Office confirmed its statement to DW.

'FAIR BUT FIRM'
In 2021, the UK introduced a major overhaul of its immigration and asylum system. Addressing Parliament In December, Home Secretary Priti Patel said the new law represented a "comprehensive, fair but firm long-term plan, which addresses the challenge of illegal migration head-on."

"Asylum-seekers deemed to have arrived in the UK illegally will no longer have the same entitlements as those who arrive in the country via legal routes," Patel said. "Even if their claim is successful, they will be granted temporary refugee status and face the prospect of being indefinitely liable for removal."

"Asylum seekers will be able to be removed from the UK while their asylum claim or appeal is pending, which opens the door to offshore asylum processing," she said.

A WORRYING MOVE
Though information on the applicant's case in question remains scant, the government's stance is a disturbing and surprising development, said Rim Turkmani, the research director for Syria with the Conflict Research Programme at the London School of Economics.

Turkmani, who has given expert evidence to the UK's Foreign Affairs Select Committee on the Syria crisis, said that, although the level of violence had abated in parts of Syria, the safety of individuals was still at risk, particularly where political motives are involved.

"Evading conscription in Syria after 2011 is indeed a political statement by men who refuse to join an army that is attacking civilians, committing war crimes, and where they may be positioned in posts where they have to take part in attacking civilian areas themselves. Seeking to avoid conscription puts the person at risk of detention, which, as documented by many human rights

Former President Donald Trump ripped "gutless" politicians who refuse to say whether or not they received the booster shot for COVID-19.

Trump's comments came in an interview that aired on One America News Network on Tuesday night. While Trump did not mention any names, Florida Gov. Ron DeSantis has notably dodged questions about whether or not he took the booster shot.

"Many politicians — I watched a couple of politicians be interviewed, and one of the questions was, ’Did you get the booster?’ because they had the vaccine, and the answer is 'yes,' but they're not answering it," he said. "Because they’re gutless. You gotta say it, whether you had it or not."

Trump also said that he does not believe "young, healthy people" should take the vaccine. He cited his son Barron, 15, whom he said was barely affected when he was infected with COVID-19. The former president also said he did not experience any side effects when he got the vaccine and argued that it saved tens of millions of lives globally.

DeSantis, who said that he received the "normal shot" of the COVID-19 vaccine, avoided a question about whether he got the booster shot in a Fox News interview last December.

The only solid evidence we do have concerning less severe cases, is that all those most susceptible have run the gauntlet or have died, and they are no longer doing any of those activities. Locking people in their house, living on delivered junk food, while broadcasting fear and shame on all media sources was just brutal to watch and I hope you all are at least half as pissed as I was.

We knew getting it wasn't much fun, even deadly. We also knew it was totally out of proportion and sure enough, the losers and petty tyrants took advantage of it.

Judge Says FTC's Antitrust Case against Facebook Can Proceed
[An Nahar] A federal judge has ruled that the Federal Trade Commission's revised antitrust suit against Meta, formerly known as Facebook, can proceed, shutting down the social media company's request for a dismissal.In a revised complaint filed last August, the FTC argues that the company pursued a "buy or bury" strategy against rivals to suppress competition.

This is the FTC's second antitrust run at the company. A federal judge in June dismissed antitrust lawsuits brought against Facebook by the agency and a broad coalition of state attorneys general that were among multiplying efforts by federal and state regulators to rein in tech titans' market power.

The FTC is seeking remedies that could include a forced spinoff of Facebook's popular Instagram and WhatsApp messaging services, or a restructuring of the company.

U.S. District Judge James Boasberg, who in June ruled that the FTC's original lawsuit was "legally insufficient" and didn't provide enough evidence to prove that Facebook was a monopoly, said in Tuesday's ruling that the the first complaint "stumbled out of the starting blocks."

But he added that, though the "core theory" of the lawsuit — that Facebook is a monopoly engaging in anticompetitive behavior — remains unchanged, the facts alleged this time around are "far more robust and detailed than before."

Meta said in an emailed statement it is "confident the evidence will reveal the fundamental weakness of the claims."

"Our investments in Instagram and WhatsApp transformed them into what they are today," the company said. "They have been good for competition, and good for the people and businesses that choose to use our products."

The US has granted South Korea a license to pay damages owed to an Iranian company, possibly a gesture from the US to Iran to move nuclear talks forward.

The US permitted South Korea to pay damages owed to an Iranian company, in an exemption to sanctions on Tehran that can be viewed as a trust-building step in the ongoing nuclear talks.

The US Treasury Department Office of Foreign Assets Control granted South Korea a "specific license" earlier this week to pay Dayyani Holdings, which is linked to the Iranian government. The amount has not been determined, but Seoul owes the company $63 million since 2018, which was not paid due to US sanctions on Iran.

The move came days after South Korean Vice Foreign Minister Choi Jong-kun met with US Special Envoy for Iran Robert Malley, as well as the Iranian and European delegations to the Vienna talks.

Iran says South Korea owes about $7 billion for oil cargo, which it has not paid after then-US president Donald Trump left the Iran deal in 2018 and imposed "maximum pressure" sanctions.

The negotiations in Vienna, which are in their eighth round, are for the US and Iran to return to the 2015 Joint Comprehensive Plan of Action, which restricted Iran’s nuclear program in exchange for the gradual lifting of sanctions until 2030.

[THEPOSTMILLENNIAL] A leading American newspaper published a controversial article about pedophiles, and the controversy heightened after the news outlet's social media account deleted its initial accompanying remarks about the piece.

USA Today attempted to reframe the controversial topic of pedophilia as something that's "misunderstood." A majority of the piece brings up how child molesters complicate the public image of pedophiles.

Inflation in 2021 7.0%; Highest since 1982
[BLSGOV] Index for All Urban Consumers (CPI-U) increased 0.5 percent in December on a seasonally adjusted basis after rising 0.8 percent in November, the U.S. Bureau of Labor Statistics reported today. Over the last 12 months, the all items index increased 7.0 percent before seasonal adjustment.
This BLS report doesn't show the time series to the 1980s. But that info is available many places. The peak inflation in the Carter years was 1979 when it was above 13%. What is remarkable to me is that 10 year and 30 year Treasury Bonds are about 1.7% and 2.1% respectively. Finally, the Eurozone inflation rate in 2021 was about 5% so the USA underperformed even that measure.

Some personal notes on ACE inhibitors
I'm sticking this in opinion because I'm writing it as I go along and it only seems appropriate.

I already linked one article today yesterday on the subject of the interaction of the virus with ACE inhibitor receptors, that was something I happened to run across this morning. Based on some stuff from yesterday, I decided it would help a little to recap some of the more important links regarding both fraudulent materials and other notes on the subject:

  • Slashdot: Retracted Covid Paper Lives on in New Citations. Way back in Spring 2020, the Surgisphere Corporation generated a huge amount of patient data out of whole cloth that purported to show that ACE inhibitors produced a negative outcome in Covid patients. It was published in the NEJM and then retracted when the fraud was discovered. Since then, it has been quoted a large number of times, and only about 1/6 of the papers referencing it have noted that it was fraudulent and retracted. See Med Page Today and the online cardiology news site tctmd for more information on this particular folllowup study.

  • In the meantime, other studies have shown that ACE inhibitors were actually helpful, even as their use among hospitalized covid patients was discontinued:

  • In the British Medical Journal: "Risk of severe COVID-19 disease with ACE inhibitors and angiotensin receptor blockers: cohort study including 8.3 million people" showed:

    Abstract Findings: "Findings Of 19 486 patients who had COVID-19
    disease, 1286 received ICU care. ACE inhibitors were associated
    with a significantly reduced risk of COVID-19 disease (adjusted
    HR 0.71, 95% CI 0.67 to 0.74) but no increased risk of ICU care
    (adjusted HR 0.89, 95% CI 0.75 to 1.06) after adjusting for a
    wide range of confounders. Adjusted HRs for ARBs were 0.63 (95%
    CI 0.59 to 0.67) for COVID-19 disease and 1.02 (95% CI 0.83 to 1.25) for ICU care...

    ...Interpretation ACE inhibitors and ARBs are associated with reduced risks of COVID-19 disease after adjusting for a wide range of variables. Neither ACE inhibitors nor ARBs are associated with significantly increased risks of receiving ICU care. Variations between different ethnic groups raise the possibility of ethnic-specific effects of ACE inhibitors/ARBs on COVID-19 disease susceptibility and severity which deserves further study.


    In other words, we adopted a practice of taking patients off of a drug they were taking already that was helpful in combatting Covid as a matter of standardized hospital protocol for the first year and a half of the epidemic because of a fraudulent paper.

    And no-one with the nation's so-called intelligence agencies performed any sort of followup investigation into the fake science that convinced us to shoot our pandemic response in the foot. I guess it was just the hobby of the owner of Surgisphere?

The COVID19 virus attacks via ACE receptors, because its "spike proteins" fit the receptors like a key into a lock.

The Ace Receptor Blockers (ARBs) occupy those receptors and reduce their ability to uptake the ACE2 enzyme. By occupying the receptors it would seem they should reduce the uptake of the virus as well.

One would expect that this reduced ability to uptake would results in a slowing of the spread and subsequent replication, giving the body more time to fight off the virus. It would also follow that by slowing the pace of the infection, it would also reduce the chances of a "cytokine storm" which is what causes the worst effects in the lungs resulting in hypoxia and death.

So why is there any question seeing that this research is the right way to go, and continue with ARB treatment, or maybe even add an ARB as a treatment for early stages of infection?

Is this another case of ivermectin and hydroxychloroquine - where a cheap generic pill is ditched in favor of expensive antivirals like remdesivir, and expensive monoclonal antibody infusions?

Tens of thousands of people have lost their jobs since October 2019 and the Lebanese pound lost more than 90% of its value. That leaves nearly 80% of the population of 6 million, including 1 million Syrian refugees, in poverty.

Lebanon's Foreign Minister Abdallah Bou Habib said the government is working on reforms, including in the corruption-riddled electricity sector. Bouhabib added that he hopes that Beirut will reach a deal with the IMF by the end of February.

Schallenberg said that there has to be a deal between Lebanon and the IMF, "in order for us as a European Union to give economic assistance."

The Austrian foreign minister said his country will continue to help Syrian refugees in Lebanon, with the eventual goal of returning them to their country.

Schallenberg is scheduled to visit Austrian peacekeepers deployed in southern Lebanon near the border with Israel.

When U.S. Capitol Police Lt. Michael Byrd went on "NBC Nightly News" to tell his side of shooting and killing unarmed Jan. 6 rioter Ashli Babbitt, he made a point to note he’d been investigated by several agencies and exonerated for his actions that day.

"There’s an investigative process [and] I was cleared by the DOJ [Department of Justice], and FBI and [the D.C.] Metropolitan Police," he told NBC News anchor Lester Holt in August, adding that the Capitol Police also cleared him of wrongdoing and decided not to discipline or demote him for the shooting.

Byrd then answered a series of questions by Holt about the shooting, but what he told the friendly journalist he likely never told investigators. That’s because he refused to answer their questions, according to several sources and documents reviewed by RealClearInvestigations.

In fact, investigators cleared Byrd of wrongdoing in the shooting without actually interviewing him about the shooting or threatening him with punishment if he did not cooperate with their criminal investigation.

"He didn’t provide any statement to [criminal] investigators and they didn’t push him to make a statement," Babbitt family attorney Terry Roberts said in an RCI interview. "It’s astonishing how skimpy his investigative file is."

Roberts, who has spoken with the D.C. MPD detective assigned to the case, said the kid-glove treatment of Byrd raises suspicions the investigation was a "whitewash." The lawyer’s account appears to be backed up by a January 2021 internal affairs report, which notes Byrd "declined to provide a statement," D.C. MPD documents show.

Germany: 2021 asylum applications highest since 2017
[DW] The highest number of asylum requests came from Syria, while over 17% of first-time applications were on behalf of children born in Germany under the age of one.

More asylum applications were filed in Germany in 2021 than at any time in the past 4 years, according to figures published on Wednesday.

Germany's Federal Office for Migration and Refugees (BAMF) said that, in 2021, 190,800 asylum applications were submitted.

It's the highest number since 2017, when more than 222,600 people applied.

The NYPD arrested a man and charged him with hate crimes on Tuesday for an attack on a Jewish man in Brooklyn last month.

The police’s Hate Crime Task Force said it charged Othman Suleiman with third degree assault and aggravated assault, and listed both charges as suspected hate crimes.

Suleiman is 27 and a resident of Staten Island, the NYPD statement said.

Suleiman is accused of attacking the Jewish man outside of a sneaker store in the Bay Ridge neighborhood of Brooklyn on December 26.

The accuser, Blake Zavadsky, said Suleiman confronted him because he was wearing an Israel Defense Forces sweatshirt.

The attacker "didn’t like it, told me I had five seconds to take it off and then he called us dirty Jews and punched me in the face twice," Zavadsky said.

Zavadsky was with another Jewish friend, Ilan Kaganovich, at the time of the attack. Both are 21 years old and in college.

Following the attack, Zavadsky and Kaganovich reached out to New York City Councilwoman Inna Vernikov, who organized a protest against antisemitism in her Brooklyn district. Vernikov, a Republican, is also Jewish.

Later Tuesday, Vernikov said Suleiman had been released on $1,000 bail. She said she was "disgusted" with the decision in a post that showed her outside the courthouse with Zavadsky and Kaganovich.

Jews were the most targeted group for hate crimes in New York City last year. The NYPD’s hate crimes dashboard reported 144 confirmed attacks against Jews between January and October 2021, out of 416 total hate crimes in the city. Teen convicted in Loudon County school bathroom rape cases sentenced to 'locked residential mental health program'
[THEPOSTMILLENNIAL] On Wednesday, the teenager at the center of the Loudoun County bathroom sex assault scandal last year was sentenced to complete a locked residential mental health program, and will be on probation until he’s 18.The defendant in the case must also register as a sex offender. He was previously found guilty on two charges of "forcible sodomy, one count of anal sodomy, and one count of forcible fellatio."

District Court Judge Pamela Brooks said "this one scares me" in response to results from the teen's psychosexual evaluation, "which evaluates a person's sexual interests to see if there is a deviation from generally accepted behavior and the risk of sexual reoffending in the future," according to NBC Washington.

"Over the years this court has read many psychosexual reports, and when I read yours, frankly, it scared me. It scared me for you, it scared me for society," remarked the judge.

Brooks said that she has never ordered a juvenile to register as a sex offender, but felt it was necessary given the details of the case.

The unnamed male teen was 14 when last year it was revealed that he raped a ninth grader in the girls' bathroom while wearing a skirt, himself. The incident happened in May of 2021, but administrative staff didn't immediately notify parents about it.

The student was transferred to Broad Run High School, where he inappropriately touched a female student in an empty classroom.

According to The Daily Wire, the boy apologized to both of his victims at the sentencing hearing. But one of the victims said she won’t accept the apology until the defendant acknowledges a third victim of his. "I hope one day you tell them what you did to that girl," she said.

A fact acknowledged by the judge. Local reporting at WJLA says Loudoun County Public Schools completed their investigation into how administrators handled the two sexual assault cases. But they cite "Virginia Code and attorney-client privilege" for not sharing their findings with the public.

This story only emerged after the school board tried passing a transgendered bathroom policy, parents began asking questions, and Superintendent Scott Zeigler inaccurately denied knowledge of any bathroom assaults that had occurred on school property.

85 Per Cent Of Sweden's Fatal Shooting Suspects Come From Foreign Backgrounds
[Breitbart] Nearly nine in ten suspects involved in fatal shootings in Sweden are either born abroad or are from migrant backgrounds, statistics reveal, as the country continues to deal with record levels of fatal shootings.

In 2021, Sweden saw another record high number of fatal shootings as the country continues to see fatal gun violence largely driven by criminal gang activity across the country.

According to statistics obtained by the French newspaper La Croix, the average age of suspects in fatal shootings in Sweden is 23 years old and claim that 85 per cent of the suspects are either born aboard or come from immigration backgrounds.

Swedish police claim that there are as many as 2,500 members of gangs in the city of Stockholm alone and that the dismantling of prior gangs made of up migrants from the Balkans who came to Sweden in the 1990s, has led to the formation of smaller and more violent gangs.

The gangs often operate in so-called “vulnerable areas” also known as no-go areas, with Swedish authorities noting that in around sixty neighbourhoods, gangs have an influence on the local community.

The statistics cited by the French newspaper echo statement made last year by Greater Gothenburg police commissioner Erik Nord who commented on the connection between mass migration and fatal gun violence.

“It is no longer a secret today that much of the problem of gang and network crime with the shootings and explosions have been linked to migration to Sweden in recent decades,” Nord wrote in an opinion article for Swedish newspaper Goteborgs Posten.

“When, like me, you have the opportunity to follow matters at the individual level, you see that virtually everyone who shoots or is shot in gang conflicts originates from the Balkans, the Middle East, North or East Africa,” Nord added.

Nord has not been the first to connect migration to gang crime and gun violence. In October of 2020, Linda Staaf, head of the intelligence unit of the National Operational Department (NOA) of the Swedish police force, noted that second-generation migrants had created a new form of gang culture in some no-go areas.

“Overall, we have three types of criminal structures: criminal organisations, such as criminal motorcycle gangs; family-based criminal networks in clan structures; and a new type of culture and network – that is, loose networks that are mainly gang criminals in vulnerable areas,” Staaf noted.

“The loosely composed networks often consist of second-generation immigrants. Parts of the clan structure are brought with them like honour and blood vengeance,” she said.
