Court Upholds Texas Ban on Big Tech Censorship
[PJMedia] A federal appeals court upheld a Texas law that bans Big Tech from censoring speech based on political viewpoint on Friday.

On Sept. 9, 2021, Texas Gov. Greg Abbott signed House Bill 20 into law. In a statement, Abbott summarized the new law:

House Bill 20 prevents social media companies with more than 50 million monthly users banning users simply based on their political viewpoints. The law also requires several consumer protection disclosures and processes related to content management on the social media sites to which the bill applies. These sites must disclose their content management and moderation policies and implement a complaint and appeals process for content they remove, providing a reason for the removal and a review of their decision. They also must review and remove illegal content within 48 hours. House Bill 20 also prohibits email service providers from impeding the transmission of email messages based on content.

The law was promptly challenged by NetChoice and the Computer & Communications Industry Association. They argued that tech companies have a First Amendment right to select and curate the content people post on their platforms. They were able to get the new law blocked, but Texas Attorney General Ken Paxton appealed that decision — and won.

Judge Andrew S. Oldham, writing for the 5th U.S. Circuit Court of Appeals, said, “The platforms urge us to hold that the statute is facially unconstitutional and hence cannot be applied to anyone at any time and under any circumstances.” But the court found that “In urging such sweeping relief, the platforms offer a rather odd inversion of the First Amendment. That Amendment, of course, protects every person’s right to ‘the freedom of speech.’ But the platforms argue that buried somewhere in the person’s enumerated right to free speech lies a corporation’s unenumerated right to muzzle speech.”

Paxton, who argued in favor of the Texas law, celebrated his win in a tweet:

In the ruling, the court upheld the argument that the tech giants are analogous to utilities:

The implications of the platforms’ argument are staggering. On the platforms’ view, email providers, mobile phone companies, and banks could cancel the accounts of anyone who sends an email, makes a phone call, or spends money in support of a disfavored political party, candidate, or business. What’s worse, the platforms argue that a business can acquire a dominant market position by holding itself out as open to everyone-as Twitter did in championing itself as “the free speech wing of the free speech party.”…Then, having cemented itself as the monopolist of “the modern public square,”…Twitter unapologetically argues that it could turn around and ban all pro-LGBT speech for no other reason than its employees want to pick on members of that community…

“Today we reject the idea that corporations have a freewheeling First Amendment right to censor what people say,” concluded the ruling.

Fox News points out that the Fifth Circuit ruling will likely send the case to the Supreme Court:

Friday’s ruling created what is known as a “circuit split,” since the eleventh circuit struck down a similar social media law in Florida. A circuit split generally increases the likelihood of the Supreme Court taking up a case.

A showdown at the U.S. Supreme Court has become necessary to break Big Tech’s stranglehold on the flow of information. It’s not right that such massive and powerful platforms choose to act as a publisher and pick and choose what content they carry while also enjoying federal protection from liability arising from that content. They can’t have it both ways, and the 5th Circuit’s decision is a crucial step toward remedying leftwing monopolistic social media.

New York mayor condemns ‘outrageous attacks’ on Jews as near-daily assaults continue

The video posted by Boro Park Shomrim, a neighborhood watch group, showed the woman pursuing an ultra-Orthodox man down a city sidewalk, screaming at him. She then swatted off his kippah and shtreimel, a traditional hat worn by Haredi men on Shabbat and holidays.

Boro Park Shomrim said the woman had been arrested.



"We will keep our streets safe," Adams said, thanking police for "their quick response to these acts of anti-Semitic hatred."

New York State Governor Kathy Hochul said, "Acts of antisemitism are abhorrent and unacceptable."

"Hate crimes will not be tolerated in New York, and we’ve strengthened our laws to further hold perpetrators accountable," Hochul said.
Unenforced laws do more harm than a lack of laws on the subject altogether.

A nearly identical incident also occurred in Boro Park earlier this week when a man riding a bicycle knocked the hat off of a Jewish man on a street.

Jews are consistently the group most targeted in hate crimes in New York City on an annual basis, in per capita and absolute terms, with the Anti-Defamation League reporting a record-high number of incidents last year. The NYPD has confirmed 149 anti-Jewish hate crimes between the start of the year and June 28, representing an incident every 29 hours on average. The attacks range from violent mostly peaceful assaults to racial slurs and property damage, and many more likely go unreported. In August, the NYPD reported 24 anti-Jewish hate crimes, far more than against any other group and a 118-percent jump over the same month last year.

Many of the attacks target visibly identifiable Jews and Jewish targets in Brooklyn. Haredi communities in the area are also feeling under attack due to an uproar over secular education in the yeshiva religious school system,

with some community leaders warning the issue could stoke further antisemitism.

Most of the attacks do not result in serious punishment, drawing the ire of Jewish advocates who have demanded changes to bail laws that could lead to harsher repercussions for assailants.

Late last month, police announced two arrests for suspected hate crimes against Jews, as Brooklyn community leaders praised police, called for bail reform and said the community was "terrified." Police also said they would step up patrols around synagogues.

This time he put his target in the hospital in April, then was released on bail the same day he was arrested by the feds in June. Supposedly he is under house arrest until his next hearing.
In some of the other incidents in the past week, a Jewish man was punched in the face repeatedly in an unprovoked attack in Queens; Nazi graffiti was sprayed on a fountain in Manhattan; and a Jewish woman was shot with a BB gun in Brooklyn.

Throughout Leonard Jeffries' speech last Wednesday, he reiterated a call to the audience: "Be prepared." He told students to form study groups, for "the truth has to be heard." I and several others did precisely that before his visit. We spent hours pouring over his Albany speech, and over dusty books in Widener.

In particular, we sought to find out the truth about Jewish involvement in the slave trade. At Albany, Jeffries said that rich Jews financed the slave trade: "We have the names, we know who they were, what they were, what they controlled. We know when they set up the Dutch East India Company, the Dutch West India Company, the Portuguese company, the Brazilian company."

I'll take the charges one at a time. The Dutch East India Company did not deal in the slave trade. As for the "Portuguese company" and the "Brazilian company," I can only assume Jeffries meant the Brazil Company, founded by Portugal to attract Jews. It too did not deal in slavery. Of the four, only the Dutch West India Company did in fact deal in the slave trade. Of the company's 3,000,000 florins in original capital, Jews contributed only 36,000, or 1.2 percent. In 1656, seven of 167 major shareholders were Jews; in 1671, ten of 192.

When I confronted Jeffries with these facts last Wednesday, Jeffries seemed shocked. First he insisted that the Dutch West India Company did deal in slavery--that is, he didn't listen to my question. The moderater intervened to make Jeffries answer my question.

Jeffries explained that the Jews had invested secretly in the company--another Jewish conspiracy. In between killing Christian babies and plotting to take over the world, these remarkable Jews found the time to invest secretly in the slave trade!

Dr. Jeffries, I would like to see your documentation--I've read the books you named, and they don't support your claims. You said I wasn't serious about my scholarship because I've never received a half million dollar grant. If you are reading this, Dr. Jeffries, I challenge you to offer me a position doing research. Dr. Jeffries, I am serious about my scholarship; are you?

Africans are still hunting down other other Africans to sell for profit. Nor is it only Africans — google slavery in Mali or slavery in Mauritania or slavery in Saudi Arabia. Some of the Chibok girls kidnapped from their Nigerian boarding school by Boko Haram in 2014 will never be returned to their families because they were sold to rich Muslims in the Middle East and beyond; many girls stolen by ISIS in Iraq and Syria were sold similarly — to jihadi groups, other people’s children are a cash crop. There are no Jews involved in any of this, but no one accuses African-Americans of hating Muslims. Clearly, the claim of Black hatred of Jewish slave sellers as the reason for this sudden rash of attacks is not merely fallacious but false on its fqce.

As for Blacks hating Jews in general, partly it is erasing the Jewish history of support for Black rights in this country, and partly it is just an easy bigotry, with 2.5 millennia of lies to provide all the excuses anyone could need — starting with the ancient Greeks. For example the heads of all the commonwealth nations (Like Canada, Australia, etc...) which the Queen was the nominal 'head of state'. Then you have the royal family, etc... Whistleblower Alleges FBI Schemed to Distort January 6 Cases into Nationwide ‘Domestic Violent Extremism' Epidemic

[Breitbart] A whistleblower has accused the FBI’s Washington Field Office of using cases related to the January 6 U.S. Capitol riot to "overstate" the threat of "domestic violent extremism" in America, according to Judiciary Committee ranking member Rep. Jim Jordan (R-OH).
"Overstate the threat"....formerly known as a Disinformation Campaign.
The whistleblower alleged the FBI office did not follow standard investigative practices for the January 6 cases when it moved the cases to various local Field Offices around the country based on where the case subjects were from, Jordan revealed in a letter addressed to FBI Director Christopher Wray on Monday.

January 6 cases "should all be officially led by the WFO [Washington Field Office] and categorized as WFO cases," according to the letter, but instead, a "task force" dispatched instructions to open January 6 investigations to local field offices nationwide.
We'll take it from here, Agent Winstead. It's very important we keep the insurrection narrative alive.
Those local offices received the cases, making it look as if they were conducting the investigations on the cases, when, in reality, the Washington Field Office continued to conduct the bulk of the work, according to the letter.
Yes, that would be the Mar-A-Lago Raider (Fok Trump at any cost) Detachment.
The whistleblower told Jordan:

The manipulative casefile practice creates false and misleading crime statistics. Instead of hundreds of investigations stemming from a single, black swan incident at the Capitol, FBI and DOJ officials point to significant increases in domestic violent extremism and terrorism around the United States.

Jordan noted in the letter, "Such an artificial case categorization scheme allows FBI leadership to misleadingly point to ’significant’ increases in DVE threats nationwide," which supports a narrative being perpetuated by the Biden administration.

The whistleblower also alleged that January 6 cases were inappropriately taking priority over other cases, citing an instance of being "told that child sexual abuse material investigations were no longer an FBI priority and should be referred to local law enforcement agencies," according to the letter.
Children? No worries. We have hundreds, possibly thousands of replacement children arriving daily.

Evidence of Hochul pay-to-play outrage mounts
[NYPOST] Gov. Kathy Hochul’s "emergency" move to overpay for COVID tests sold by a big donor looks even more squalid in the face of news that Caliphornia, an impregnable bastion of the Democratic Party, paid half as much for the same tests.

The Times-Union reported Friday that California paid 45% less for the same COVID-19 tests that New York bought from a company tied to $300,000 in donations to the Hochul campaign — a firm that pre-pandemic sold electronic hoverboards.

Cutting out the contributions-giving middleman might have saved $286 million out of the $637 million in total payments to Digital Gadgets, whose founder Charlie Tebele and his family gave $70,000 to Hochul’s campaign before landing the contract and another $227,000 afterward.

Hochul was able to do this without normal review (her team took the deal in less than a day) under emergency powers that she kept extending month after month until recently, after news of this deal made headlines.

Not that it’s her only pay-to-play scandal: Hochul’s giveaways to the Buffalo Bills’ owners and to a Penn Station-area developer also reek.

Attorney General Letitia James and Comptroller Tom DiNapoli ought to be looking into all of this, along with the gov’s naked appeals to special interests for campaign cash. Heck, since James warned businesses, big and small, against price-gouging, she should be probing Digital Gadgets as well.

Then again, James and DiNapoli have both endorsed Hochul, a fellow Democrat. Consider their silence here fresh proof that a one-party state is a corrupt one.

Progressives hateful push for hard-left New York Court of Appeals
[NYPOST] Radical progressives are looking to turn the state’s highest court into a rubber stamp for their agenda. The nakedly ideological drive is an assault on the independent judiciary, a bulwark of democracy.

On Wednesday, City & State reported that a top gay Democratic club wrote Gov. Kathy Hochul to condemn the openly gay judge who now serves as acting chief on the Court of Appeals. It’s just part of the unseemly effort to muscle Hochul into nominating a lefty to replace departing Chief Judge Janet DiFiore.

"Although Judge [Anthony] Cannataro is openly gay, he does not represent our values," wrote Jim Owles Liberal Democratic Club prez and LGBTQ activist muppet Allen Roskoff. That clearly means he’s not guaranteed to ram the entire lefty agenda, from handcuffing cops to mandating children’s "right" to gender-transition surgery to protecting the anti-Israel Boycott, Divestment and Sanctions movement, down the public’s throat.

From the moment DiFiore announced her retirement, progressives rushed to denounce her and the high court’s so-called "conservative" majority, which quite rightly stood by the trial-court judge who struck down state Democrats’ blatantly unconstitutional gerrymander. Their gripes extend to other cases where the court didn’t make the "right" decision in cases involving tenants, immigrants colonists, criminal defendants and the green agenda.
