[NYPOST] On day two of his manslaughter case, Daniel Penny ceased having a name.
He became merely ''the white man.''
During the prosecution's opening statements on Friday, they asked why Penny, 26, did ''not see Mr. Neely's humanity.''
On Monday, the Marine Corps veteran — facing 15 years for the subway chokehold that killed mentally ill homeless man Jordan Neely — was reduced by the same prosecution to his race and sex.
Over and over.
This started when 19-year-old Ivette Rosario, a bystander on the train that day, was called to the stand. Rosario, appearing visibly shy and nervous, captured a short, shaky video of Penny holding Neely in a chokehold on the uptown F train.
It became clear that Rosario, whose voice at times, was barely audible, did not know Penny's name so she referred to him as ''the white guy.''
But she was not corrected by Assistant DA Jillian Shartrand, nor did the lawyer inform Rosario of the defendant's name. Instead, Shartrand adopted it as her own, calling him ''the white man.''
Shartrand continued to question Rosario, referring to the defendant as such, more than a half a dozen times. It was jarring to hear it repeated so casually.
Given the racial undertones of the case, with BLM protesters hurling accusations of Penny being a ''racist vigilante,'' it felt doubly reckless. Even if it wasn't wholly malicious.
In fact, when Penny's defense attorney, Thomas Kenniff, got up to cross examine Rosario, his client's name was the first order of business. He clarified that ''the white man'' was indeed his client and kindly agreed with Rosario that they'd refer to him as ''Danny'' and Neely as ''Jordan.''

The Municipal Transportation Agency board, which oversees the Muni Metro light rail network in the city, approved a new contract with Hitachi Rail to upgrade its existing train control system, which was first installed at the Market Street subway station in 1998.
The software that runs the Automatic Train Control System (ATCS) is stored on floppy disks that are loaded each morning, according to the San Francisco Chronicle.
Three floppy disks are used for loading DOS software that controls the system’s central servers, according to Ars Technica.
DOS, which stands for disk operating system, was used to power IBM personal computers through the 1980s and 90s. But the rising popularity of Windows and other graphical user interfaces led to its demise.
"When a train enters the subway, its onboard computer connects to the train control system to run the train in automatic mode, where the trains drive themselves while the operators supervise," Michael Roccaforte, an SFMTA spokesperson, told Ars Technica in April.
"When they exit the subway, they disconnect from the ATCS and return to manual operation on the street."
Roccaforte said that the initial plan was to transition away from floppy disks beginning in 2018. The entire process was expected to last a decade.
There is an open source DOS replacement that boots from a USB key. That's all they would need to replace the floppies. If they want to run it on new computers, there are lots of cheap controller boards

Russia-linked disinformation operations have falsely claimed officials in battleground states plan to fraudulently sway the outcome of the extraordinarily close US presidential election, authorities warned hours before voting began Tuesday, adding that they also expected Iranian-linked operations to try to stoke violence by spreading disinformation.

The latest ODNI statement cited the example of a recent video that falsely depicted an interview with a person claiming election fraud in Arizona, which involved creating fake overseas ballots and changing voter rolls to favor Harris.

US officials warned in late October that Russia-linked operations were behind a viral video falsely showing mail-in ballots for Trump being destroyed in the swing state of Pennsylvania. The video, which garnered millions of views on platforms such as X, purported to show a man sorting through mail-in ballots from the state’s Bucks County and ripping up those cast for Trump.
The Bucks County Board of Elections branded the video as "fake," saying that the envelope and other materials depicted in the footage are "clearly not authentic materials" belonging to or distributed by them.

Cyabra, a firm that uses AI to detect online disinformation, said on Monday that an X account with 117,000 followers played a key role in helping spread the fake video.
X’s spokesperson said the social media platform took action against many accounts that shared the video.
In September, the Microsoft Threat Analysis Center said Russian operatives were ramping up disinformation operations to malign Harris’s campaign by disseminating conspiracy-laden videos.

At least 87 of Musk’s posts this year have promoted claims about the US election that fact-checkers have rated as false or misleading, amassing 2 billion views, according to the Center for Countering Digital Hate’s report.
In Pennsylvania, one of the seven key swing states, some X users have seized on instances of local election administrators flagging incomplete voter registration forms that would not be processed, falsely casting the events as examples of election interference, said Philip Hensley-Robin, Pennsylvania executive director at Common Cause, during a press briefing on Monday.
Common Cause is a nonpartisan organization that promotes accountable government and voting rights.
Some X accounts implied "that there was voter fraud, when in fact, we know very clearly that election officials and election administrators in all of our counties were following the rules and... therefore only eligible voters are voting," Hensley-Robin said.
The 2024 US presidential campaign has been a particularly volatile one, and security for Election Day on Tuesday is being ramped up to unprecedented levels given concerns over possible civil unrest, election chicanery, or violence against election workers.
The states of Oregon, Washington and Nevada have activated the National Guard — and the Pentagon says at least 17 states have placed a total of 600 National Guard troops on standby if needed.

[Washington Examiner] Democratic political campaigns have paid hundreds of thousands of dollars to a consulting firm facing investigations in Pennsylvania counties for allegedly submitting fraudulent voter registration forms, federal records show.
The district attorney of Monroe County, Pennsylvania, Mike Mancuso, said in a statement last week that a subsidiary of a firm in Arizona called FieldCorps was responsible for submitting 30 forms with fraudulent details, including on behalf of a dead resident. And in York, another county in the Keystone State, officials are looking into suspicious forms they say were submitted by FieldCorps on behalf of the Everybody Votes Campaign, a group tied to the Washington, D.C.-based Arabella Advisors dark money network supporting Democrats.
Now, as of Saturday, the website for FieldCorps and its social media accounts do not appear to be active. Francisco Heredia, a city councilman in Mesa, Arizona, listed on corporate documents as the owner of the consulting firm, did not return a request for comment. Eduardo Sainz, a political consultant who is a partner at the firm, also did not respond.
The unfolding drama in Pennsylvania comes ahead of Election Day on Tuesday and a matchup between Vice President Kamala Harris and former President Donald Trump. Pennsylvania is a key swing state in 2024 and the results in counties there could decide who enters the White House next year. A Washington Examiner review of Federal Election Commission filings found that, since 2018, Democratic campaign committees have shuffled roughly $430,000 to FieldCorps.
The FieldCorps subsidiary is working out of Lancaster County, Pennsylvania, according to state officials, who have declined to identify whether FieldCorps is the "third-party organization" behind an investigation officials opened there into 2,500 voter registration forms flagged as suspicious.
I vote they make the entire state redo the election, this time with Republican Party lawyers and trained poll watchers in each precinct, and each voter required to provide a photo ID and proof of residency. Democrats were confronted earlier this year with a terrifying reality: a cap on out-of-pocket costs for patients to limit Medicare drug spending passed as part of Biden’s signature Inflation Reduction Act was set to spike premiums for millions of senior citizens just weeks before the 2024 presidential election.
To avoid the political catastrophe of presiding over major premium increases in the middle of a closely contested election, the Biden-Harris administration used its authority to reroute appropriated funding to subsidize the premiums for seniors until after the election.
The administration’s $5 billion budget gimmick kicked the proverbial can down the road, but only adds to the estimated possible $20 billion in additional spending over three years to cover up the unintended consequences of one of the Biden-Harris administration's signature laws.
While they free Democratic nominee Kamala Harris to tout the caps in her key economic plan for the middle class, the subsidies will cost taxpayers and seniors in the long run.
“They created a new program that's going to send billions to health insurance companies… to temporarily offset the premium increases,” Rebecca Weber, the CEO of the Association for Mature American Citizens (AMAC) told the John Solomon Reports podcast.
“One could really say that they're buying, you know, off big insurance companies right before an election. And taxpayers, this is important, that people understanding it, taxpayers are footing the bill today, seniors will pay the price tomorrow,” she added.
Medicare Part D premiums were slated to increase in October at the beginning of open enrollment following pressure on insurance companies generated by the Inflation Reduction Act’s caps on drug prices—one of the Biden-Harris Administration’s signature legislative initiatives.
This could have spelled political disaster for Democrats and their nominee, who bragged that she cast the tie-breaking vote on the legislation.
But the administration swooped in to prevent the catastrophe. The Centers for Medicare and Medicaid Services announced in July a new program to stabilize the premiums, called a demonstration. This program would shell out a total of approximately $5 billion in subsidies for insurance companies to cover the costs of capping prices and other effects of the Inflation Reduction Act.
Before the subsidies, the price cap plan was already set to balloon federal spending after the Congressional Budget Office found the Inflation Reduction Act’s financial impacts were underestimated.
The analysis, requested by Republican critics of the administration’s plans, said the changes made to Medicare by the act would likely cause the new average plan bid for standard Part D coverage to increase by a whopping 179% for 2025 without intervention.
“CBO expects that the additional plan costs reflected in those bids will result in an increase in federal spending of $10 billion to $20 billion in calendar year 2025, compared with our earlier projections,” the CBO said.
