SCOTUS May Reverse Harris Mandate on Donor Disclosure
[PJ Media] On Monday, the Supreme Court heard arguments in the key First Amendment case Americans for Prosperity v. Rodriguez, which centers on the State of California’s requirement that nonprofit organizations disclose their donor information to the state. Back in 2015, then-Attorney General Kamala Harris (D-Calif.) demanded that two conservative nonprofits, Americans for Prosperity (AFP) and the Thomas More Law Center (TMLC), hand over their donor lists. This demand threatened to reveal the identities of donors, potentially subjecting them to threats and harassment.

Legal representatives for AFP and TMLC said the Supreme Court justices’ questions and remarks suggested they are likely to strike down California’s requirement as an unconstitutional violation of the First Amendment.

"The justices appreciated very well that membership and donations to an organization are protected by a right to privacy in association, not just a right to associate," legal counsel for Americans for Prosperity Foundation, said on a press call after the oral arguments on Monday.

She noted that the justices cited many friend-of-the-court briefs written by ideological opponents of AFP and TMLC that nonetheless support these conservative organizations’ rights to donor anonymity. The American Civil Liberties Union (ACLU), the National Association for the Advancement of Colored People (NAACP), and the Human Rights Campaign (HRC) proved particularly noteworthy in this regard.

John Bursch, legal counsel at Alliance Defending Freedom (ADF) and a lawyer for TMLC, cited specific statements or questions that the justices made during oral arguments.

He noted that Justice Neil Gorsuch suggested that a ruling for California might allow the government to demand the addresses of donors that nonprofits use when they send out Christmas cards.
Not until they decide to cancel Christmas.
Justice Brett Kavanaugh cited the fact that the ACLU, the NAACP, and HRC came forward in opposition to Kamala Harris's donor disclosure mandate.
Precedent!
Justice Clarence Thomas "explained that the government used confidential census data information to locate Japanese citizens for internment," Bursch noted. "Sotomayor noted that donors may not have faith in California" because the state had leaked the records of more than 1,700 donors.

When California's lawyers argued that most non-profits would not object to providing donor lists, Justice Amy Coney Barrett said, "That's not how the First Amendment works." She noted that speech zones on college campuses may violate the First Amendment even if most students support speech zones.

While California claims the Kamala Harris donor disclosure mandate is necessary for fraud investigations, Bursch noted that "California has never used the schedule B information that it collects in advance" for its investigations, and it "never has a problem getting that information after the fact."

California's lawyers have claimed that it is advantageous for the state to have donor information at its fingertips. Bursch wryly noted, "It might also be advantageous to the government to allow officials to warrantlessly go into homes. That would certainly deter criminals from acting, but the violations [to Americans' constitutional rights] are outrageously disproportionate."
Power! More power!
Brian Hauss, an attorney with the ACLU, joined Sullivan and Bursch on the call, even though the ACLU does not represent any of the parties in the case. "Certainly, we don't see eye to eye with the petitioners in this case on every issue," Hauss began in a massive understatement. "However, First Amendment rights apply to everyone."
Even conservatives and white supremacists. But not Trump voters.
Hauss noted that, since the information of 1,700 donors had been leaked from California before ‐ including Planned Parenthood donors ‐ "it is entirely reasonable for donors to fear that their private information will become public."

"California cannot require charities to disclose the identities of their donors if the state cannot guarantee that that information will remain confidential," the ACLU lawyer insisted.
Not only confidential, but also not used for nefarious purposes, such as the internment of citizens based on the ancestry (1942). Or the cancelling of conservatives.

A Republican-led initiative in Caliphornia, an impregnable bastion of the Democratic Party, to recall incumbent Democratic Governor Gavin Newsom has enough valid signatures to appear on the ballot, state election officials said Monday.

The petition to recall Newsom has so far received 1.6 million valid signatures, according to California's Secretary of State office. Officials have until Thursday to provide a final count of the signatures.

Although California has not officially approved the recall election, it will most likely take place next fall. Voters will have 30 days from Thursday to decide whether they still want to go forward with the recall.

So far, three Republicans have entered the race to defeat Newsom, with celebrity and transgender activist Caitlyn Jenner the most recent candidate to join the fray.

Newsom was elected in 2018 with 62% of the vote, after having previously served as the state's lieutenant governor and the mayor of San Francisco.

"The Republican recall threatens our values and seeks to undo the important progress we made — from fighting COVID, to helping struggling families, protecting our environment, and passing commonsense gun solutions," Newsom tweeted on Monday. "There's too much at stake."

Newsom will likely survive the recall, due to California's status as a stronghold for the Democratic Party

Maricopa County Judge Recuses Himself From 2020 Election Audit Case
Slowly we turned. Step by step, inch by inch... It appears only our side will ever look at this information until it becomes so well known on our side and so overwhelming that the New York Times, et al will have to report it in self defense.
[EpochTimes] The judge who was overseeing a legal challenge to the Arizona Senate’s audit of votes cast in the state’s largest election during the 2020 presidential election has recused himself from the case less than 24 hours before a scheduled April 26 hearing.

Maricopa County Superior Court Judge Christopher Coury recused himself from the legal challenge on April 25 after learning that attorney Chris Viskovic, with whom he’d had a prior working relationship, had joined the case, 12 News first reported.

According to a copy of the recusal obtained by the news outlet, the court received filings at 4 p.m. April 25 that included names of new attorneys, including Viskovic, who worked at the office of Coury "as an extern within the past five years."

Viskovic now holds a position as a junior associate at Kolodin Law Group PLLC, which is representing the Florida-based cybersecurity firm Cyber Ninjas in court. Cyber Ninjas is one of four firms hired by the state Senate to conduct the audit.

The recusal notes that in accordance with the state’s code of judicial conduct and rules of the Arizona Supreme Court, Coury must recuse himself from any further involvement in the case.

The Arizona Senate liaison for the audit said in an April 25 statement: "We look forward to the assignment of a new Judge and a rescheduled hearing as soon as possible. Meanwhile,

the audit continues."

Coury, a Republican, was replaced by Judge Daniel Martin in the case on April 26.
New Judge in Maricopa County Audit Case Was Not Only Appointed by Democrat Janet Napolitano, He Has Ties to the Marc Elias Firm Perkins Coie
The audit taking place in the state’s largest county started on April 19. Companies hired by the state Senate are examining 2.1 million ballots, testing voting machines, looking for IT breaches, and performing a hand count.

The state-issued subpoenas that were needed to execute the audit were ruled as valid on Feb. 25.

Arizona Democrats filed an emergency request to block the audit on April 22. Coury granted the request the following day but only if the party would post a $1 million bond. Democrats refused, so the audit wasn’t paused.

During a hearing earlier in the day, Coury did say that he would temporarily pause the audit until at least April 26 so he could hear more about concerns Democrats laid out in a lawsuit.

Coury isn’t popular among Democrats, who campaigned to oust him last year from another four-year term on the bench over his ruling on an education ballot proposition called Invest in Ed.

in October 2020 campaigned to oust Coury, creating a website that called him an "activist judge" after he ruled that the summary for the proposed tax hike for education was misleading.

The other firms hired by the Republican-majority state Senate to conduct the audit include Wake Technology Services, CyFIR, and Digital Discovery.

A report is expected to be released on the audit’s findings in about two months.

More seriously, who paid for this $17.99 book to hand out to every illegal border surger that Biden is welcoming into the country? How many were handed out? If it was a thousand kids at the Long Beach facility, that could mean $17,990 for Kamala's bankbook assuming the books were only handed out there alone. The New York Post, which broke the story and has a great cover, reported that no one at the Long Beach center wanted to say.

Well, someone paid. And someone connected to the Bidenites doesn't want you to know.

It's as mysterious a purchase as the Biden t-shirts being worn by thousands of illegals who demanded to be allowed into the U.S.

It does point to a pretty strong possibility of corruption, for one. Book deals with their big payouts and large buying orders, have been endless sources of corruption since at least the 1990s.

And it certainly resembles what the Democrat mayor of Baltimore was successfully prosecuted for last year - her "Healthy Holly" series - and last April she checked in for a three-year stretch in federal prison for that book scheme.

So one day a sophisticated young lady in my company was talking to a hot-tempered higher-ranking lady in my company, and made a remark about "trailer trash." To which the higher-ranking lady replied in an icy voice, "I grew up in a trailer". Which almost everyone in the company except the young lady already knew. It was like that moment just after someone yells "Grenade!"

The "trailer trash" lady was one of our best hires ever. Like a Texas football coach would say, she was agile, mobile, and hostile.

Texas picks up two House seats in newest census while Democratic stronghold states lose out
Good. Now to keep Texas from being turned blue.
[NBCNEWS] The Census Bureau on Monday released state population totals that determine each state's number of House seats, with just seven seats moving among 13 states — the smallest shift since the current congressional apportionment model was adopted in the 1940s.

Texas was the biggest winner, gaining two House seats. Colorado, Montana, Oregon, Florida and North Carolina each gained one seat.

The losses were concentrated in the industrial Midwest, with Illinois, Michigan, Pennsylvania, West Virginia and Ohio each losing a seat. Democratic strongholds California and New York each lost a seat. Census officials said New York would not have lost its seat if 89 more people lived in the state.

That 89-person difference was what separated New York from maintaining its 27th seat versus Minnesota keeping its eighth, which it managed to hang on to.

Kristin Koslap, a senior technical expert for the 2020 Census Apportionment Division, said Monday at a news conference that "it's not unusual for there to be a small margin" in population that determines whether a state gets an additional seat, loses one or maintains the status quo.

In terms of total population, the census counted 331,449,281 Americans, a 7.4 percent increase from the 2010 census. California remains the largest state and Wyoming the smallest.

The average population per-House seat is now 761,169 people, an increase of more than 50,000 per-district from the average of 710,767 in 2010.

Sen. Graham Supports Denying Quorum If Democrats End Filibuster

(R-S.C.) said Wednesday Senate Minority Leader Mitch McConnell (R-Ky.) should do anything he needs to stand up to the Democrats’ "radical agenda," including denying quorum.

"To borrow a phrase from Senator Schumer, when it comes to standing up to the most radical agenda in U.S. Senate history—All options are on the table for Republicans," Graham wrote on Twitter. "Republican needs to make it clear that if there is an effort to change the filibuster ... we, as Republicans, will use all the tools in the toolbox to stop the power grab—including the denial of a quorum."

Quorum refers to the number of senators that must be present for the Senate to do business. The Constitution requires a majority of senators (51) for a quorum.

Democrats have recently been more vocal about getting rid of the Senate filibuster, an action that prolongs debate and delays a vote on a measure. Before 1917, Senate rules didn’t provide a way to end a debate and force a vote on a measure, but that year they adopted a rule that enabled a two-thirds majority (67-votes) to end a filibuster via a procedure known as cloture, which later changed to 60-votes.

Durbin, who previously supported the filibuster rule, has recently come out in opposition. Durbin in March argued that the filibuster was damaging the nation’s democracy.

McConnell said Republicans would fight back if Democrats eliminated the filibuster to push their agenda forward.

"It would not open up an express lane for the Biden presidency to speed into the history books, the Senate would be more like a 100-car pileup, nothing moving," McConnell recently said on the Senate floor.

Not only are Senate Democrats are coming out in strong opposition to the filibuster, but House Democrats are also calling for it to be abolished.

"Well, at this point in time, we are in the same position. I am one who has said regularly, long before this year, that I thought that the filibuster was undemocratic and inconsistent with the Founder’s principles. I bet you could not find a single Founder, a single writer of the Constitution of the United States, who would have said the Senate cannot pass a bill by majority vote, not one," said House Majority Leader the mealy-mouthed Steny StinkyHoyer

To vote to rid the Senate of the filibuster rule, the Senate would need 51 votes, but two Democrat senators have committed to keeping the rule, Sens. Kyrsten Sinema (D-Ariz.) and Joe Manchin (D-W.Va.).

If the Republicans prevent the Senate from having a quorum, the senate session would be forced to stop and senators would adjourn, severely delaying the legislative process.

"I hope it doesn’t get to this point for the sake of the country," Graham said.

Gretchen Whitmer and Other Michigan Lunatics Tell 2-Year-Olds To Mask Up
[Outkick] Starting today across the state of Michigan, two-year-olds at daycare facilities will be required to mask up, thanks to an order from the Michigan Department of Health and Human Services. Kids from ages 2-4 will now be subjected to mask requirements just like the rest of Michigan citizens, according to MDHHS representative Bob Wheaton, who told MLive.com that two-year-olds will be required to wear a mask at a park just like 18-year-old senior in high school.

The new rules will require daycare workers to keep masks on two-year-olds. One daycare worker told Mid-Michigan Now that she’s concerned for the two-year-olds who are learning from teacher facial expressions and expressions from classmates. "Something might be super exciting and fun, but they can’t see that so they don’t know how to react," Nicole Bellanger from Lady Di Daycare told the news channel.

Bellanger added that three-year-olds at the facility are speaking less since they started wearing face masks. "The mask will definitely put an impact on that. So we won’t be able to know what they say or what they want so that will make more behavioral issues because they can’t talk. So kind of like how babies cry because they have no other way of communicating now these 2-year-olds are going to have that same thing, so they’ll stop talking as much," said Bellanger.

Yet still, the state says it’s time to mask up the two-year-olds through May 24 when the order is set to expire.

House Republican Conference Chair Liz Cheney is not ruling out a potential presidential bid, The Post has learned.

"I’m not ruling anything in or out — I’ve been here a long time," she told The Post when asked if she would ever consider running in the future.

The Wyoming Republican — who has been a frequent target of former President Donald Trump — said there are a number of contenders she sees as having potential for the 2024 nomination, adding that she believes the lawmakers who led the efforts on challenging the election on Jan. 6 should be out of the running.

"I think we have a huge number of interesting candidates, but I think that we’re going to be in a good position to be able to take the White House. I do think that some of our candidates who led the charge, particularly the senators who led the unconstitutional charge, not to certify the election, you know, in my view that’s disqualifying," she said.
