A controversial Arizona sheriff known for taking a hard line against illegal immigrants has been stripped of some of his powers in what he described as a political move by the Obama administration.

Joe Arpaio, a gruff lawman who styles himself as America's toughest sheriff, has won acclaim from US anti-immigrant forces for his relentless pursuit of mostly Hispanic illegal immigrants in Maricopa county, Arizona, a fast-growing county of 4 million people that is home to Phoenix, the nation's fifth largest city.

Under a two-year-old agreement with the federal department of homeland security, Arpaio and his deputies had been authorised to enforce federal immigration law by arresting suspected illegal immigrants in the field and by checking the immigration status of people arrested on other offences.

But after drawing thousands of complaints and a civil rights investigation from the justice department, Arpaio was this week stripped of his federal authority to make immigration arrests. County attorney Andrew Thomas, one of Arpaio's supporters, condemned the "setback in the fight against illegal immigration".

For his part Arpaio has promised to continue chasing illegal immigrants using state laws. In an angry press conference, he called US homeland security officials "liars" and said he would personally drive those caught on the streets to the border if federal officers refused to take arrested illegal immigrants into custody. "I'll take a little trip to the border and turn them over to the border," he said.
This creates an interesting situation. Maricopa county is in central Arizona, but en route to the border, Arpaio would have to pass through very liberal Democrat, very Mexican legal and illegal immigrant Pima county (which includes Tucson). Even more important, he will have to enter the 100-mile "internal perimeter" of the Border Patrol's jurisdiction, where the feds might directly interfere with him.

Eloquent and fitting for the transnationalists. Where once the national government stood for LAW, they now stand to oppose LAW. The contract has been broke as in "We the People.."

#3  Joe Arpaio and the politicians who support him - Andrew Thomas prime among them (Who should run for higher office IMO)- has played a significant role in preventing Phoenix from turning into a California style just-another-one-of-a-dozen-illegal-den-crime-holes.

If the liberal feds slime their way in and muck up what is working for Phoenix, Phoenix becomes another L.A.

IMO, Arizona should, while it still has enough backbone to do it, assert it's 10th ammendment right, then proceed to defend it's borders and cities.

If the feds won't allow them to run immigration checks, they should make state laws that are stricter with regards to employer backround checks, require supporting and verified federal documents before issuing state I.D.s (meaning Arizona will have to verify SS numbers with the feds before issuing state I.D.s - like the employee verification laws) and laws allowing Arizona to deport people - Either to Mexico or another state that will accept them - who don't have the federal documents (SS, Birth Cert or passport) required to get a state I.D.

The Problem With 'Hang-Time'
Since Maricopa County Attorney Andrew Thomas took office in 2005, he has asked for death sentences in murder cases more than 120 times - more than any other top prosecutor in Arizona history.

His support of the death penalty is unwavering: He has run for election and re-election on the pledge he will continue to seek capital sentences.

Consequently, the number of death-penalty defendants swelled faster than the court system could handle. There just weren't enough judges, prosecutors and qualified defense attorneys available. At the beginning of 2009, there were 129 defendants awaiting trial in capital cases in Maricopa County, most of them years beyond the 18-month time period in which, under court rules, they are supposed to be tried.

But now, the number of capital cases is being whittled down rapidly.

Faced with a growing backlog and further delays in justice, the Superior Court has made some aggressive changes. Presiding Criminal Judge Gary Donahoe and other leaders of the Superior Court are refusing to postpone trial dates in death-penalty cases and demanding that prosecutors and defense attorneys discuss settlements, which would mean less than a death sentence.

The goal is to apply pressure to resolve cases more quickly, but both Thomas and defense attorneys question whether justice is being best served.

Court officials are standing firm.

"I think firm trial dates settle cases," Donahoe said. "People start looking at their cases when it gets close to their trial date and start making decisions as to whether they want to go to trial or settle it. They can plead, go to trial, dismiss. We don't really care which. But we want to get the case resolved."

So far, the tactic has worked. Despite his hard-line pledges, Thomas this year has allowed 27 defendants who faced the death penalty to plead to life sentences or less. That's nearly twice as many as last year and eight times as many as in 2005.

Thomas also has filed fewer notices of intent to seek the death penalty, or death notices.

As of today, there are only 100 capital defendants in trial or awaiting trial. There is a schedule to try or settle more than 20 of those cases before year-end.
The real issue here is that too many scoundrels have complicated the process far more than it ever should have been.

Their repeated and constant obstruction to the death penalty is proof that they neither support nor believe in a democracy or republic, but just enough of the facade of one to keep the serfs in place.

Third Time's A Charm
Philadelphia, PA - Police say that a robber, who had already victimized two other people that evening, approached his third victim just after midnight. The robber reportedly shoved the victim against a vehicle, threatened him, and demanded money. The victim, who was armed for self defense, drew his handgun and shot the robber, ending the attack.

A bystander called 911, and police arrived to find the robber dead and the victim unharmed. The victim had a concealed carry permit, and police say they do not expect any charges will be filed against the robbery victim.

Crack thugs sue city: Lawyers settle cop-abuse raps for $500K
Members of a brazen Brooklyn crack gang raked in more than $500,000 in taxpayer money by repeatedly suing the city for civil rights violations, records show.

Accused drug dealers from the East 21st St. Crew and associates sued the city more than 20 times - and the city settled every time, even though many of the same people sued again and again.

The reason: The city's policy of aggressively settling cases rather than risk a big judgment after a costly trial.

Law enforcement officials are outraged at the repercussions.

"They [the reputed drug dealers] are raising hell in the community and collecting judgments on top of it," one police source said. "They were emboldened; taunting cops."

Authorities say the gang ran a street-level crack operation that wreaked havoc on an East Flatbush neighborhood before being busted last month. Investigators say they have gang members on tape making more than 100 sales to undercover cops in two years.

"This was a very violent crack crew," city Special Narcotics Prosecutor Bridget Brennan said. "A real thorn in the side of the community."

Incredibly, court records show the gang pulled in much better money from suing the city in Brooklyn Federal Court, claiming cops violated their civil rights.

One crew member, Shamel King, got $117,500 from the city, in six separate claims, including one for $35,000 and three for $20,000 each. King, charged with 37 sales, was caught on video smiling as he counted out crack rocks, a law enforcement source said.

A main target of the East 21st St. Crew, Anthony Lawrence, was shot multiple times and wounded Aug. 31 in his apartment, apparently by gunmen who went to rob him of his latest settlement check from the city - for $17,500, law enforcement sources said. Lawrence collected $40,000 in settlements. He was indicted on 11 counts of drug selling.

Another reputed crew member, Affection Johnson, got three settlements totaling $41,500. Johnson was indicted on 39 counts.

"It's crazy," said Michael Palladino, president of the Detectives Endowment Association. "How could this happen more than once?"

Law Department spokeswoman Connie Pankratz said, "Within the last 10 years, there has been a significant increase in the number of cases that we've settled."

She said the city is sued 200 times a week, and that claims against the police have increased. As of July 1, the city has paid out $637.7 million in judgments and settlements this year.

The department "is responsible for protecting the city's [fiscal situation]," she said. "Although we are often successful at trial, it can be more expensive to defend a case than to settle it."

She said that since the indictment, these cases were being reviewed "at the highest levels" of the department. Asked if the agency would make any changes to prevent such an egregious playing of the system, she said, "We would like to prevent this, but each case has to be weighed."

Asked if city lawyers checked into King's background after the first three suits, Pankratz said they believed it was more responsible to settle than go to trial.

In the suits, some of which date back several years, the accused dealers claimed that cops - most of them assigned to Brooklyn South Narcotics - fabricated cases, conducted illegal strip searches, falsely arrested them and harassed them while they were merely walking down the street.

They sued after their arrests were dropped or adjourned contemplating dismissal.

The majority of the suits were handled by lawyer Richard Cardinale, who was successful in a class-action suit against the city for illegal strip searches at Rikers Island, and in cases against Brooklyn South Narcotics cops. He said the clients paid him one-third of their settlements as his fee.

"The cases that I brought, those individuals were innocent of those charges," Cardinale said. "The district attorney had dismissed the cases."

He suggested the recent indictment was retaliation. "I spoke to some of the families, and they said the officers who arrested them made comments like, 'You like to bring stupid lawsuits?'"

The dozen accused members of the East 21st St. Crew were indicted in September. Eight were arrested; four already were in jail.

Undercovers made dozens of crack purchases in and around the Ditmas Arms on E. 21st St., where King and Lawrence live.

Brennan said the gang made 171 sales to undercovers totaling $10,460, many from inside Star USA, a 99 cent store at Flatbush and Ditmas Aves.

Kuwait calls for delay on Gulf currency launch
[Al Arabiya Latest] Kuwait, one of four Gulf states to sign a pact to launch a monetary union and single currency, on Sunday called for a delay in the 2010 launch date, citing incomplete preparations.

"The ministry of finance calls for revising the target date for launching the Gulf single currency until all committees and concerned parties have completed technical issues," the ministry said in a statement cited by the KUNA news agency.

The ministry, however, still expressed the support of the state of Kuwait for the project.

Kuwait, Saudi Arabia, Qatar and Bahrain in June signed an accord to create a joint monetary union council, a prelude to establishing a Gulf central bank and launching a monetary union and single currency.

The remaining two members of the Gulf Cooperation Council (GCC), the United Arab Emirates (UAE) and Oman, did not sign after deciding to withdraw from the project.

The UAE was upset at the selection of the Saudi capital Riyadh to host the future GCC central bank, while Oman withdrew from the monetary union saying it was not ready to meet the preconditions.

Kuwait is due to host the forthcoming GCC annual summit in December which is expected to take a decision on the single currency.

The GCC states have set 2010 as the target to launch the monetary union and single currency, but many experts believe that target is too ambitious and unrealistic.

Myanmar brings in everything
[Bangla Daily Star] The Myanmar military brought in heavy tanks, artillery guns, 12 warships and a frigate along its border with Bangladesh in the last 24 hours ended yesterday evening as part of its preparation for a large-scale conflict with Bangladesh, sources at the Bangladesh Armed Forces said.

Bangladesh also has strengthened its military build-up in a bid to repulse a Myanmarese incursion by preparing 30 warships in Chittagong and Khulna, a Navy official stationed at Chittagong told The Daily Star.

However, Foreign Minister Dipu Moni at a press conference yesterday rejected reports about the heavy military build-up by Myanmar along Bangladesh border, saying it is a routine movement of the security personnel.

"I had talks with our ambassador, an army officer, in Myanmar and he told me that it is a routine practice," she said, adding, "Foreign Secretary Mijarul Quayes also called the Myanmar ambassador in Dhaka and the envoy conveyed him the same message."

Ground reality did not support the foreign minister's claim as various sources in the military, Bangladesh Rifles (BDR) and intelligence agencies said that the situation on the border remained tense.

"The situation at Bangladesh-Myanmar border has remained tense," Major General Mainul Islam, director general (DG) of BDR, said last night.

The BDR DG met State Minister for Home Affairs Shamsul Haq Tuku yesterday and 'normally' discussed the border situation.

"I am going to place some proposals tomorrow (Monday) to include construction of more Border Operations Outposts across the border and a few more battalions to strengthen the border guards," he told The Daily Star.

An intelligence agency official said Myanmar has doubled its military presence at the border over the last couple of weeks, a move that has prompted Bangladesh to take similar measures.

"Myanmar has sent in 37/57mm artillery guns that will bring Chittagong under their firing range," the Navy officer told The Daily Star after the foreign minister claimed normalcy at the border.

Based on the information so far gathered, we suspect that Myanmar is making preparation for a short-scale naval conflict, he said.

"Suspicious military preparations have been going on at the Myanmarese side of the border over the last two months," an intelligence official said, adding that the Myanmar army has newly deployed two battle units at their side.

Earlier Myanmar had deployed nine Light Infantry Battalions in its border with Bangladesh. As part of their repeated provocative acts, the junta has violated international border rules and constructed illegal barbed wire fences along the frontier.

"We in the Bangladesh Navy suspect that Myanmar wants to intrude into our sea and declare a large chunk of area as their Maritime Exclusive Zone," the Navy official said.

The Myanmar junta can intrude into the Bangladeshi waters any time to claim ten nautical miles area, which covers the disputed block, which is thought to be a big source of oil and natural gas, he said.

Sources said after Bangladesh's maritime boundary talks with Myanmar ended inconclusively in April, Bangladesh Navy made a deployment plan last September and sent it to the government for immediate action. The deployment plan urged the government to strengthen maritime patrol at the Bay of Bengal and arrange joint naval exercises with friendly countries.

Meanwhile, sources in Sittwe (formerly known as Akiab) said that Myanmarese Air Force Tatmadaw has stationed three fighter planes at the Sittwe airfield. Sittwe is only 80km away from Chittagong airport.

Twelve warships are constantly patrolling the Bay area, which borders Bangladesh, the sources added.

French Muslim footballers agree to play gay team
[Al Arabiya Latest] A mainly Muslim non-league French side said they could take on rivals consisting of gay players after all, four days after snubbing them in what the former Saturday insisted was a "misunderstanding."

Paris Foot Gay (PFG) were set to play fellow Creteil side Bebel, who are composed of mainly Muslim players last week but Bebel cried off a day beforehand, sending an email in which they regretted they could not honor the match as doing so was "against their principles".

"Sorry, but because of the name of your team and in keeping with the principles of the team, which is a team of practicing Muslims, we cannot play against you," said the e-mail, according to PFG's co-founder and current president Pascal Brethes.

It added: "Our convictions are stronger than a game of football. Sorry to have informed you so late."

PFG deplored what they saw as a "homophobic" decision.

But on Saturday, Bebel director Zahir Belgharbi insisted there had been "a misunderstanding" and sent out a statement through club lawyer Benedicte Puybasset indicating they were indeed ready "to play the match."

Puybasset regretted that the matter had grown out of all proportion but local league president Jacques Stouvenel told AFP both clubs had been summoned to a meeting next Tuesday to assess the situation, warning that Bebel could be disciplined or even thrown out of the league.

Belgharbi told AFP Saturday's statement was designed to "re-establish the truth and settle everything on the grounds of good sense," rowing back on the initial snub.

"We had rejected playing this match not on the grounds of homophobia, as we have been accused of doing, but simply because the name of the club (PFG) did not seem to us to reflect our vision of sport, " said Belgharbi, saying his club believed no ethnic or religious slant should be placed on footballing matters.

"We reacted by turning down the invitation from Paris Foot Gay for fear of it leading to an instrumentalisation on the part of this club in that it was highlighting the homosexuality of its players," he added.

Crybaby WH aide: Fox News operates like an arm of the GOP
Far from backing away from its recent slam at 24-hours cable news outlet Fox News, the White House is stepping up its criticism of the cable news network.

"The reality of it is that Fox often operates almost as either the research arm or the communications arm of the Republican Party," White House Communications Director Anita Dunn said in an interview that aired Sunday on CNN's "Reliable Sources."

Dunn said that Crybaby in Chief Obama had recently chosen not to appear on Fox because of the administration's belief that Fox is ideologically predisposed against Obama and his agenda.
Because speaking only to those who agree with one is the way to change the minds of those who don't. Is the University of Chicago Law School properly mortified yet?
But Dunn pointed out that during his presidential campaign and since being elected, Obama has been interviewed by Fox News, and will be again in the future. "He'll go on Fox because he engages with ideological opponents," Dunn told CNN's Howard Kurtz. "He has done that before and he'll do it again."
I must have missed it.
But Dunn was quick to add that the White House does not consider an interview with Fox comparable to interviews with other media outlets. "When he goes on Fox, he understands that he's not really going on it as a news network, at this point. He's going to debate the opposition. And that's fine. He never minds doing that."
Which is why we see him on Fox all the time.
"They're widely viewed as a part of the Republican Party -- take [the GOP's] talking points, put'em on the air, take [the GOP's] opposition research, put'em on the air." Dunn also told Kurtz.

"But let's not pretend that they're a news network the way CNN is," the White House communications director added.
Nice doggie.
Oddly enough, the reason Fox News has viewers is precisely because they're not a news network like CNN, which has become a not-news network. Like New York Times readers, CNN watchers have no opinions on the critical news of the moment, because CNN doesn't report those stories.
You'd think that at some point professional pride would cause CNN to assert its independence; then again, lapdogs are most comfortable when in someone's lap ...
In a written statement given to CNN, Fox News said its programming was comparable to the editorial page of a newspaper.

"An increasing number of viewers are relying on Fox News for both news and opinion," Fox News Senior VP Michael Clemente said in the statement, "and the average news consumer can certainly distinguish between the A-section of the newspaper and the editorial page, which is what our programming represents.

"So with all due respect to anyone who might still be confused about the difference between news reporting and vibrant opinion, my suggestion would be to talk about the stories and the facts rather than the attack the messenger . . . which over time has never worked."

In an interview with Time Magazine released late last week, Dunn said Fox News was "opinion journalism masquerading as news."
As opposed to those who filter the news according to what they see fit to print? Hmm. I'll take the former.
"They are boosting their audience. But that doesn't mean we are going to sit back," also told the magazine.
You'll find sneakier ways to slant the news I'm sure.

Maybe more surprising is that those at Fox broadcasting and the Fox News Channel combined to give $41,853 to the Democrats, with no listed donations going to the Republicans. (Only $1,280 was listed as coming from Fox News employees.)

The contributions of individuals who reported being employed by major media organizations are listed in the nearby table. [See link above to article.]

The contributions add up to $315,533 to Democrats and $22,656 to Republicans — most of that to Ron Paul, who was supported by many liberals as a stalking horse to John McCain, a la Rush Limbaugh's Operation Chaos with Hillary and Obama.

What is truly remarkable about the list is that, discounting contributions to Paul and Rudy Giuliani, who was a favorite son for many folks in the media, the totals look like this: $315,533 to Democrats, $3,150 to Republicans (four individuals who donated to McCain).

Let me repeat: $315,533 to Democrats, $3,150 to Republicans — a ratio of 100-to-1. No bias there.

#6  As others have noted upthread, Fox is primarily if not exclusively staffed by independents and nominal Democrats like Chris Wallace.

I wonder if anyone at Time remembers when the Republican Party was the political arm of the Luce family, and Time was vociferously arguing for "the American Century" and "Americanism"?

Victim's parents hang young Iranian killer
[Al Arabiya Latest] An Iranian man was hanged Sunday reportedly by the parents of his victim whom he murdered in a brawl as a teenager, despite international calls urging the Islamic republic to stop such executions.

Behnoud Shojaee had been convicted of stabbing to death 17-year-old Ehsan Nasrollahi during a fight in August 2005 when he himself was aged 17, Iranian news agencies reported.

His execution was postponed at least once last year and again in August.

"The mother and father of Ehsan Nasrollahi themselves carried out the punishment in the Evin prison," the agency ISNA said in reference the notorious detention facility in Tehran.

#2  Vendetta is a basic human behavior. Eye for eye.. What the proto-states promised to end a cycle of violence between clans/tribes/et al was to become the third disinterested party to render 'blind' justice. The fundamental problem today is that the state lacks the will to perform that function. The legal caste is too wrapped up in ritualistic processes, image, and unrealistic expectations/demands. The cycle of gang violence in our own metropolitan areas is a reflection that it is losing that legitimacy to act as a third party.

#3  The state's monopoly on violence is supposed to short-cut the vendetta cycle. Letting the parents "execute" the guilty party negates the whole point of the exercise.
