#5 I think the problem for Fox was that they didn't always weasel during reports, e.g., 'we have an allegation that...'. There were probably some very nasty things said that Fox didn't want to come out during trial, e.g., "I don't care if it is true or not, I want this on the air NOW"

#6 Settlement/payoff is a reasonable theory.
Another is that Fox looked at the judge and potential jury and decided they were going to lose.
Hard to tell without more data but something is hinky. Inquiring minds want to know!
