#10 Meh. Kerry got away with violating the Logan Act int the 70s when he negotiated with the North Vietnamese government during an active conflict.

#11 Depending on what he is telling them. If he's letting them in on confidential or secret information then I think its a little more than Logan Act violations - more like Treason.
And I don't think he (or the Clintons or Obamas) would hesitate to do so.
