The fundementum of Affirmative Action. Admissions offices at elite universities are simply in league with government and industry. After five or six decades, a practice that should be obvious to the casual observer.

First, if AA is struck down, no one is going to notice, because the Biden Administration will refuse to enforce it.

Second, look for the media to start hitting GOP candidates with "Enforce = Racism".

Third, the schools will stand up and refuse to change their ways, claiming that it's the same as standing up against the Fugitive Slave Laws, etc.

#4 ^ Problem with that scenario is a flood of lawsuits for "unequal before the law" treatment.

No matter what the "great cause" may be, there will always be lawyers ready to go after the deepest pockets.

#16 The unspoken corollary for those prestigious universities is that the disparity in admissions will also reflect an eventual disparity in competence. Once in, a pattern of race-based failure rates will be equally unacceptable, and compensation in grading and performance will leak in the system as academic integrity also falters. So in time, a minority graduate from the ivies will be presumed to be of lesser skill and ability, since merit and achievement are suspect. Absent genuine, credible meritocracy, the extreme cost of such institutions will spell their own extinction.
