Ta'kiya Young's experiment with shoplifting comes to an abrupt end
[NBC] An officer fatally shot a pregnant woman who police suspected of shoplifting Thursday night in an Ohio grocery store parking lot after officials say she accelerated her car toward an officer.

Police Chief John Belford called the shooting a "tragedy" and an "unfortunate loss of life" in a video statement.

The chief did not identify the woman or disclose she was pregnant, but the Franklin County Coroner’s Office identified her as 21-year-old Ta’kiya Young and confirmed she was pregnant.

The office said she was pronounced dead shortly before 7:45 p.m. Thursday.

While Blendon Township officers were helping a driver who was locked out of her car outside a Kroger, a store employee told officers about a theft by someone who was fleeing, the chief said.

#2  Yeah, something about a car with increasing velocity coming towards a police officer might give the officer the idea that the driver might need to be neutralized.

But imagine if Ta'kiya succeeded in running over the police officer. I would bet dollars to donuts we would not be seeing words such as "tragedy" and an "unfortunate loss of life".

Three people killed in 'racially motivated' shooting in Jacksonville
Link fixed.
[NBC] A shooting at a Dollar General store in Jacksonville, Florida left four people dead, including the shooter, on Saturday, with authorities saying they believe the attack was racially motivated, local media reported.

Jacksonville Sheriff T.K. Waters stated during a press conference that the suspect was wearing a tactical vest and armed with an "AR style" rifle and a handgun and killed three people before turning the gun on himself. All three victims of the shooting were black, according to the sheriff.

The suspected shooter, a white male, had authored several manifestos to his parents, the media, and federal agents. The shooter's rifle was reportedly covered in swastikas and other extremist symbols.

The shooter was believed to live in nearby Clay County with his parents, Waters said, and has had previous interactions with law enforcement.

In 2016, he was involved in a call about a domestic disturbance, which resulted in no arrests. In 2017, he was subject to the Baker Act, which provides "emergency services and temporary detention for up to 72 hours for mental health examination" if, among other criteria, there's reason to believe a person is mentally ill and because of mental illness "has refused voluntary examination."


So his racism may well just be what his mental illness chose to latch on to, and not a thing he would continue to believe were he properly medicated. Along with not feeling the need to go out and murder a bunch of strangers.

Longtime 'Price Is Right' host Bob Barker dies at 99

[NPR] Game show host Bob Barker has died at the age of 99.

"It is with profound sadness that we announce that the World's Greatest MC who ever lived, Bob Barker has left us," publicist Roger Neal said in a statement.

Barker, whose career spanned more than eight decades, was best known as the longtime host of The Price Is Right on CBS. In 2002, he broke Johnny Carson's record for continuous performances on the same network TV show.

Barker began hosting The Price is Right when Richard Nixon was in the White House. He remained with the show for 35 years before retiring in 2007. Even at the end of his career, the then-80-something host was still taping five shows a week.

7 people shot at annual Caribbean parade in Boston
[10News] Police confiscated firearms and arrests were made.

Seven people were shot during an annual Caribbean parade in Boston on Saturday morning.

The Boston Police Department said officers responded to reports of an active shooting in the area of Blue Hill Avenue and Talbot Avenue at 7:44 a.m. This was during the J'ouvert Parade, which kicked off the festivities in Boston at 6:30 a.m. The main parade, Caribbean Carnival, was scheduled to begin at 1 p.m.

The victims were transported to the hospital with non-life threatening injuries, Boston police told Scripps News.

Police said firearms were recovered and arrests were made.

Boston City Council President Ed Flynn spoke out in a post on X.

"Today's mass shooting highlights the gun violence crisis we are facing. This is a public health & public safety emergency," Flynn wrote. "[Boston Police] continue to confiscate and recover guns at an alarming rate and now is the time to come together & develop a gun violence strategy in Boston."

Boston City Councilor At-Large Erin Murphy said she met with Flynn, Boston Police Captain Joseph Boyle, residents and business leaders to discuss safety and health concerns in the city.

"This is an event for children, on a Saturday morning, and it's appalling that bad actors would visit violence and evil on it," Murphy posted on X.

Police said an investigation remains ongoing.

3M Agrees to Pay More Than $5.5 Billion Over Military Earplugs
[Bloomberg Canada] 3M Co. has tentatively agreed to pay more than $5.5 billion to resolve over 300,000 lawsuits claiming it sold the US military defective combat earplugs, people familiar with the deal said.

The settlement would avert a potentially much larger liability that 3M sought to curb though a controversial bankruptcy case that ultimately collapsed. The sum is about half the roughly $10 billion some financial analysts predicted 3M could end up paying over allegations that the earplugs didn’t adequately protect the hearing of service members.

Bloomberg Intelligence had estimated that the company’s potential liability was as much as $9.5 billion, while analysts at Barclays put it at about $8 billion.

"Sounds like 3M negotiated a pretty good deal for itself, given this litigation has been weighing on them for the better part of a decade," said Carl Tobias, a University of Richmond law professor who teaches about product liability cases.

A 3M representative said the company doesn’t comment on rumor or speculation.

Costly Verdicts

The accord would end a torrent of litigation facing the St. Paul, Minnesota, company even as it faces thousands of other lawsuits over PFAS "forever chemicals" likely to cost several times more than the earplug deal to resolve. 3M has lost 10 of 16 early trials over the earplugs so far, with over $250 million awarded to more than a dozen service members.

In the most recent trial, a Florida jury ordered the manufacturer in 2022 to pay a US Army veteran James Beal $77.5 million in damages over his hearing loss from the earplugs. Beal, who tested weapons over a four-year period starting in 2005, said he developed hearing loss and tinnitus, a buzzing or hissing sensation in the ears.

The hundreds of thousands of lawsuits have been consolidated in a multi-district litigation before a federal judge in Florida for pretrial information exchanges and test trials, according to federal court records. In the suits, current and former service members allege 3M knew its earplugs were too short to work effectively and that it failed to warn the US government or users, or to take steps to fix the product.

Under the terms of the settlement, the maker of popular consumer products such as Scotch tape and Post-it notes would pay out the money over five years, said the people, who requested anonymity because they weren’t authorized to speak publicly about the accord. They said 3M’s board still must sign off on the deal.

Bankruptcy Strategy

3M had sought to limit its liability by having its Aearo Technologies unit seek Chapter 11 protection from creditors in 2021 to corral the cases. Critics including law professors and consumer advocates attacked the maneuver as an example of profitable companies using the process as a shield without filing for bankruptcy themselves.

In June a bankruptcy judge threw out Aearo’s case, finding that 3M wasn’t in the kind of financial trouble that warranted using the bankruptcy system to manage litigation. Aearo has appealed the ruling. A similar move by Johnson & Johnson to resolve cancer cases filed over its baby powder through bankruptcy was rejected this year.

As 3M’s bankruptcy strategy languished, lawyers for the company and the service members pursued a settlement in mediation required by the judge overseeing the earplug litigation, US District Judge Casey Rodgers. Rodgers, who served in the Army from 1985 through 1987, ordered 3M Chief Executive Officer Mike Roman in May to travel to Florida for negotiations.

According to the lawsuits, the earplugs were defective over a 12-year period starting in 2003. In 2012, there were 971,990 tinnitus claims lodged with the US Veterans Administration, government records show. Experts estimate such claims are rising 15% annually.

The earplug accord isn’t 3M’s first. In 2018, after a whistleblower lawsuit, the company agreed to pay $9.1 million to settle civil allegations by the US Justice Department that it failed to disclose defects it knew about to the military.

As for the forever-chemicals litigation, 3M has agreed to pay as much as $12.5 billion to clean up drinking water supplies across the US that are tainted with the substances.

#2  ...I discovered early on that wearing the little yellow earplugs was for some reason physically uncomfortable enough that I requested - and got - a medical review. End result was that I had it in writing that I was authorized 'Mickey Mouse Ears' hearing protection, and I used those.

Those complaints were filed with the VA. A lot of WW2 Army Air Corps personnel suffered hearing lost related to both flight and ground support around those bombers.

Alabama Ready To Be First To Kill Inmate By Forced Breathing Of Nitrogen
[ZH] Alabama is ready to pioneer a new means of executing convicts -- by forcing a condemned man to breathe pure nitrogen.

That man is Kenneth Eugene Smith. Now 58, Smith was convicted in 1988 for killing the wife of a preacher -- in a murder-for-hire scheme initiated by that preacher, who hoped to cash in on a life insurance policy and pay off his debts. The victim, Elizabeth Sennett, was found dead in the couple's home on Coon Dog Cemetary Road in rural Colbert County, having been bludgeoned with a fireplace tool and stabbed nine times in what was supposed to look like a home invasion.

Smith and his partner in crime carried out the murder for payments of just $1,000 each. That partner was executed in 2010. The preacher spared everyone the legal hassle: After investigators honed in on him, he confessed to his sons and their families that he'd had an affair and hired the killers -- then immediately strolled to his old pickup truck, sat in the front seat and shot himself, fatally.

An attempt to execute Smith via lethal injection in 2022 was called off when executioners struggled to insert an IV tube into his vein. Now the Alabama attorney general is ready to give it another go, this time using "nitrogen hypoxia." On Friday, AG Steve Marshall asked the Alabama Supreme Court to set a date.

While colorless, odorless nitrogen comprises 78% of the air we breathe daily, breathing 100% nitrogen will theoretically cause the prisoner to first pass out and then die.

"Placed into a pure nitrogen environment, the convict would be unconscious within a minute (possibly even after a breath or two) and would be dead soon after," Charles Blanke, a professor of medicine at Oregon Health & Science University School of Medicine, told Fox News. "Its failure rate, that is, cases in which the prisoner survives, would likely be much lower than what we see with current death penalty methods."

Alabama has yet to provide details on its planned methodology -- for example, whether inmates would be placed in a gas chamber or simply fitted with a special mask. If it's the latter, a good seal is essential to ensure the death isn't prolonged by oxygen in the execution room.

The nitrogen hypoxia method has been on the books in Alabama since 2018. Oklahoma and Mississippi have likewise authorized the method, but none have used it yet. Lethal injections have proven increasingly problematic, owing to shortages of the drugs used in the process.

Those shortages are driven in part by manufacturers not wanting their product used to kill people -- even the most evil ones. In 2011, Hospira, the only domestic producer of one of three lethal-injection ingredients -- sodium thiopental -- stopped making it. In 2012, the FDA made it illegal to import the drug to be used in executions.

Given its novelty, nitrogen hypoxia will be ripe for legal challenges on behalf the condemned. "No state in the country has executed a person using nitrogen hypoxia and Alabama is in no position to experiment with a completely unproven and unused method for executing someone," Equal Justice Initiative attorney Angie Setzer told Associated Press.

Alabama doesn't have to prove the humanity of nitrogen execution. "The burden is on the condemned inmate to show that it is torturous rather than the burden being on the state to show that it’s not," said Richmond University law professor Corinna Barrett Lain in an interview with Scientific American. Lain's choice for most humane method? Firing squad.

Alabama death row inmates are literally lining up to be polished off via nitrogen. In legal action dating back five years, several inmates have sued to be killed that way, rather than lethal injection.

Haiti: several displaced by gang attacks near affluent neighborhood
[AFRICANEWS] Residents of Carrefour-Feuille in the Haitian capital Port-au-prince had to flee their homes Friday to escape another bout of gang violence.

All morning, people left the area in a hurry, holding the few belongings they could salvage.

Unconfirmed reports say that houses were looted and burned, and people were killed in the latest attack.

"The gangs are there (Carrefour-Feuille). There was a lot of shooting yesterday. I had to leave my house and take only a few clothes. All my children left, and I don’t know where they are, five young boys that are in the streets and I can’t find them, and my husband is blind," shared Destiney Mauliere, displaced resident.

The Haitian National Police informed that it would secure the area, but it did not stop the gangs from continuing a violent mostly peaceful takeover of yet another part of the capital.

The local population had organized vigilance brigades to contain the exactions of the gangs that terrorize 80% of the city.

"I don’t have anywhere else to go. I only have what is here, my ID. I don't know what they took. I don’t know If they burned down my house and stole everything I have," deplored Jean Edouard Amazan, also displaced.

The Carrefour-Feuille neighborhood, a stone's throw from affluent district Pétionville has been the target of violent mostly peaceful attacks by the Ti Lapli gang since August 13th.

Since president's Moise's liquidation, gangs have seized control of up to 80% of the capital.

Port-au-Prince, killing, raping, and sowing terror in communities already suffering endemic poverty.

Grieving Mother Desperate For Answers After FBI Busts Down Door, Fatally Shoots Her Disabled Veteran Son in Pre-Dawn Raid
[Gateway] A family is desperately seeking answers after FBI agents busted down the door and killed their relative in a pre-dawn raid last week.

The FBI is refusing to tell a grieving mother why they showed up in armored vehicles at 6 am last Wednesday and fatally shot her son.

According to WBBJ, FBI agents showed up at a residence in Henderson, Tennessee to serve a man named Theodore Deschler an arrest warrant when things turned deadly.

A neighbor told WBBJ he woke up at 6 am after he heard a loud bang.

"I was woken up at about six o’clock this morning. I heard a loud bang. Then I heard a couple more. I heard the loudspeakers, ’Come out with your hands up. We’re the FBI. We’re not going anywhere.’ Before I knew it, I was coming out to see what was going on and watched them bust out their windows," a neighbor told WBBJ.

Theodore’s family believes he was unarmed when the agents busted down the door and threw flashbangs into the home.

"It was a senseless act. You know Teddy was a 100% disabled veteran. He had problems. He had severe PTSD. He had depression but he was getting help for it but this was senseless. He didn’t have a weapon on him. He was just trying to get out of the house because it was filled with tear gas," Theodore’s mother told WBBJ.

The house was destroyed by tear gas, flashbangs and bullets. Most of the windows were busted out.

The FBI-involved shooting is currently under investigation so the family is in the dark about the details of the raid.

UN chief urges global financial architecture reform at BRICS Summit
[AFRICANEWS] The UN chief called Thursday (Aug. 24) the global financial structure 'outdated, dysfunctional and unjust.'

Antonio Guterers said the "pandemic [had] underscored once again" the system's flaws.

"[The financial system] has failed in its basic function as a global safety net. And so, it needs deep structural reform," he added.

As he urged for a reform at the BRICS summit in Johannesburg, Guterres also stressed the importance of a U.N. charter and international law-based multi'lateralism.

"We are entering a multipolar world.
People keep saying that, so perhaps it’s true.
But history has shown, time and again, that multipolarity without strong multilateral institutions is no guarantee for stability. It might even become a catalyst for chaos. So, we must urgently restore trust and reinvigorate multilateralism."

"And this requires the courage to compromise for the common good. It requires effective international institutions in rooted in 21st century realities, based on the U.N. charter and international law."

US Marines plan to procure 3 Iron Dome batteries, nearly 2,000 interceptor missiles
[IsraelTimes] Deal with Rafael partner Raytheon, expected to be worth hundreds of millions of dollars, includes 44 launchers and US-made command centers.

An existing prototype system — known as the Marine Corps’ Medium-Range Intercept Capability (MRIC) — combines the Iron Dome’s launcher and Tamir interceptor missiles with a Marines radar and command center.

Originally designed to intercept rockets, the Iron Dome has been upgraded and improved to allow it to also shoot down mortar shells, unmanned aerial vehicles and cruise missiles.

The Iron Dome, which was first developed in Israel but was expanded significantly with US funding, has been in operational use for over a decade in Israel, principally against short-range rockets fired from the Gazoo
