Daniel Penny trial judge agrees to drop top manslaughter count after jury deadlocks twice

Friday after jurors twice said they couldn’t agree on a verdict in the highly watched subway chokehold case.

The note from jurors stating that they were deadlocked on the count of manslaughter in the second-degree sparked a dizzying and dramatic back-and-forth that ended with Manhattan Supreme Court Justice Maxwell Wiley agreeing to dismiss the rap.

“I’ll take a chance and grant the people’s application,” Wiley said, instructing the jury to return Monday and deliberate the charge of criminally negligent homicide, which carries a lighter sentence.

“Whether that makes any difference or not, I have no idea. But I’m going to direct you to focus your deliberations on count two,” he said with a touch of deadpan humor — before telling them: “Go home and think about something else.”

#8  Article this am indicated that the prosecutors asked for the charge to be dropped, in order to hopefully get a conviction on the lesser charge as opposed to a mistrial which throws out both charges, tho in that case a re-trial would be possible.

Which proves this is a political court, not a court of law. If the first charge results in a hung jury, the judge anywhere else would declare a mistrial and everything would start over.

The arguments and focus has been mostly on count one, but now the jury is tainted in how it looks at count two and I guarantee if they find him guilty an appeals court will overturn it.

I'm close to just thinking the NY court is in a state of insurrection and every member needs hung.

Romania annuls first round of presidential votes won by far-right candidate
[NYPOST] Romania's top court annulled the first round of presidential elections on Friday over allegations that Russia interfered to prop up far-right outsider Calin Georgescu, who won the first round.

The unprecedented, binding decision from the country's Constitutional Court means that the second round run-off election scheduled for Sunday, which would have pitted Georgescu and his centrist rival Elena Lasconi against each other, has been canceled.

Sitting President Klaus Iohannis declassified intelligence on Wednesday that revealed Russia ran a sweeping social media campaign consisting of thousands of accounts to promote Georgescu across platforms like TikTok and Telegram.

Georgescu, an outsider nationalist who claimed he spent zero money campaigning, suddenly emerged as the front-runner on Nov. 24.

National polling 2 weeks before the election had Georgescu at less than 1%.
