[Federalist] Lawfare leftists lost another round in their bogus "fake electors" scheme to imprison Trump supporters, this time in Nevada where the state’s Democrat attorney general is pushing an 11th-hour political prosecution.
Clark County District Judge Mary Kay Holthus on Friday shut down a trial slated for early next year in the case of six grassroots conservatives charged with felony forgery counts for serving as contingent electors for then-President Donald Trump in the disputed 2020 election. The judge found prosecutors for far-left Attorney General Aaron Ford erred in choosing Democrat bastion Clark County, home to Las Vegas, as the venue for the trial. As the Nevada Independent reported, the judge agreed with the defendants’ attorneys, who argued the a northern venue should have been selected, particularly within Carson City — where the alternate elector signing ceremony actually took place in the weeks after the presidential election in which Democrat Joe Biden narrowly claimed victory in the swing Silver State.
[Newsweek] Attorney General Merrick Garland on Tuesday pushed back on attacks on Special Counsel Jack Smith and the Department of Justice (DOJ).
In an opinion column titled "Unfounded attacks on the Justice Department must end" published by the Washington Post on Tuesday, Garland discussed the ongoing attacks against the department including threats, conspiracy theories and falsehoods, adding that recently it has involved Smith as he has led investigations into Donald Trump.
Newsweek has reached out to the Department of Justice and Trump's spokesperson via email for comment.
"In recent weeks, we have seen an escalation of attacks that go far beyond public scrutiny, criticism, and legitimate and necessary oversight of our work. They are baseless, personal and dangerous. These attacks come in the form of threats to defund particular department investigations, most recently the special counsel's prosecution of the former president," Garland wrote.
Garland continued by noting a specific example following Trump's guilty verdict in the criminal hush money case, which was brought forward by Manhattan District Attorney Alvin Bragg.

[NYPOST] Embattled Oakland Mayor Sheng Thao blasted the federal investigation that led to the FBI raiding her Caliphornia, an impregnable bastion of the Democratic Party, home last week — claiming if she was rich and went to an elite school she wouldn’t have been targeted. That's a "tu quque" ("You do it too") fallacy, right? Only she's trying to make it sound like an "Et tu, Brute" argument.
Thao, who is facing a recall fate in November over rising crime and the departure of the Oakland A’s, was defiant in her first remarks since agents were seen at a home where she lives.
"I want to be crystal clear: I have done nothing wrong," Thao said Monday. "I can tell you with confidence that this investigation is not about me."
She claimed that she was being targeted when other politicians have done much worse. See? "Hoc etiam facis."
"This wouldn’t have gone down the way it did if I was rich, if I had gone to elite private schools or if I had come from money," she said.

Thao’s home was raided early Thursday morning along with two other homes in the Oakland area belonging to David and Andy Duong, a father-and-son team who run California Waste Solutions and have recycling contracts with Oakland, NBC Bay Area reported.
Both Duongs have donated hundreds of thousands of dollars to local politicians over the years, including to Thao.
It remains unclear exactly what the investigation concerns, but agents were seen carting boxes out of Thao’s home during the raid.
Thao, who shares the house with her partner, was apparently home with her son when the FBI arrived.
The mayor became emotional during the presser, wiping away tears as she recalled growing up as the daughter of poor refugees.
"When my parents came to this country fleeing genocide, they never could have imagined that their daughter would one day be mayor of Oakland. I am my ancestors’ wildest dream," she said.
"And I am your mayor: Mayor Sheng Thao."
Not everybody wants it to be that way, however.
Since she took office in 2023, crime in Oakland has sharply increased, with violent mostly peaceful crime and burglaries rising more than 20% from the year prior.
Some have of blamed the progressive Thao for the troubles, and in May a petition for a recall vote gained the necessary 25,000 signatures needed to bring it to ballot this November.

Oakland mayor’s attorney quits after being surprised by news conference Embattled Oakland Mayor Sheng Thao’s attorney has resigned as her counsel after the mayor gave a press conference Monday without informing him. Tony Brass, a high-profile attorney who also represents accused Bob Lee killer Nima Momeni, was retained as Mayor Thao’s counsel late last week after the Federal Bureau of Investigation raided her Oakland home.
“I have officially withdrawn as Sheng Thao’s counsel,” Brass told Bay City News, via text message.
The mayor remained silent for several days, declining to speak about the raid or to address a mass shooting in Oakland Wednesday, in which 15 people were shot at a Juneteenth celebration. On Monday, she broke her silence, addressing the shooting briefly before launching into a fiery, and at times emotional statement about the raid.
In the statement, which KRON4.com has learned she did not inform her attorney about ahead of time, Mayor Thao implied the FBI raid was connected to an ongoing recall effort against her. She also at times suggested that there were “radical rightwing forces” and a “handful of billionaires” from San Francisco and Piedmont “hellbent” on ousting her from office.
She provided no evidence to support those claims.

[NYPOST] Lawyers for Hunter Biden officially requested a new gun trial Monday, saying the trial judge didn’t have jurisdiction over his case because of a legal technicality.
The move comes a week after attorneys for President Biden’s son filed the same motion before mysteriously withdrawing it minutes later, days after he was convicted of unlawfully owning a gun while hooked on drugs.
In the new motion, Hunter, 54, asked for his June 17 conviction to be scrapped, claiming Delaware federal Judge Maryellen Noreika didn’t have jurisdiction over the trial because of pending rulings in his appeals case.

David Harbach, who led cases against former North Carolina Sen. John Edwards and former Virginia Gov. Bob McDonnell issued the stunning statement inside Cannon's courtroom Monday, in a case where Trump critics complain she has repeatedly ruled against the government. If he does it again, just have him shot.
'I just want to apologize about earlier," Harbach said following a contentious courtroom exchange. "I didn’t mean to be unprofessional. I’m sorry about that."

A federal prosecutor in Donald Trump's classified documents case clashed with the judge Monday when he made a request to bar the former president from making threatening comments about law enforcement agents involved in the investigation.
Special counsel Jack Smith’s team is seeking to make as a condition of Trump’s freedom pending trial a prohibition on remarks that could endanger agents participating in the case. Prosecutors say those restrictions are necessary after Trump falsely claimed last month that the FBI was prepared to kill him when it searched his Florida estate, Mar-a-Lago, for classified documents two years ago.
But prosecutor David Harbach, a member of Smith’s team, encountered immediate pushback from U.S. District Judge Aileen Cannon, a Trump appointee, whose handling of the case has generated intense scrutiny.
The judge questioned Harbach about how she could fashion an order that did not run afoul of Trump’s First Amendment rights and whether prosecutors could prove a direct link between Trump’s comments and actions that might then follow.
"There still needs to be a correlation between the alleged, dangerous comments and the risk" to public safety, she said.
At one point, as he tried despite frequent interruptions from Cannon to rattle off the multiple rationales that he said existed for speech restrictions on Trump, a visibly exasperated Harbach noted acidly that "I’ve got one reason out so far."
The comment drew a rebuke from Cannon, who said, "Mr. Harbach, I don’t appreciate your attitude." She said that if he could not behave in a more professional manner, one of his colleagues could take over.
Harbach completed his arguments and later apologized to the judge, saying he hadn’t meant to be unprofessional.
Defense lawyer Todd Blanche disputed the idea that Trump’s comments posed an imminent threat to anyone in law enforcement and said prosecutors’ request would have a "chilling" effect. Trump is the presumptive Republican presidential nominee and is set to debate President Joe Biden on Thursday
Trump's often-incendiary rhetoric has carried legal consequences in other cases. The New York judge presiding over Trump's hush money trial, in which he was convicted of 34 felony counts last week, fined him a total of $10,000 for violating a gag order that barred him from verbal attacks on witnesses and jurors. A federal judge in Washington handling his election subversion case imposed a similar gag order last year that an appeals court later upheld.
It was not immediately clear when Cannon, a Trump appointee whose handling of the case has been closely scrutinized, might rule. The arguments are part of a three-day hearing that began Friday to deal with several of the many unresolved legal issues that have piled up in a case that had been set for trial last month but has been snarled by delays and a plodding pace. Cannon indefinitely postponed the trial, and it's all but guaranteed that it will not take place before the November presidential election.
Trump faces dozens of felony charges accusing him of illegally hoarding top-secret records at Mar-a-Lago and obstructing the FBI's efforts to get them back. Given the breadth of evidence that prosecutors have put forward, many legal experts have regarded the case as the most straightforward of the four prosecutions against Trump, who has pleaded not guilty. But Cannon has been slow to rule on numerous motions and has proved willing to entertain defense requests that prosecutors say are meritless.
Smith's team objected last month after Trump claimed that the FBI was prepared to kill him while executing a court-authorized search warrant of Mar-a-Lago on Aug. 8, 2022. He was referencing boilerplate language from FBI policy that prohibits the use of deadly force except when the officer conducting the search has a reasonable belief that the "subject of such force poses an imminent danger of death or serious physical injury to the officer or to another person."
Trump falsely claimed in a fundraising email that the FBI was "locked & loaded ready to take me out & put my family in danger."
Prosecutors say such comments pose a significant foreseeable risk to law enforcement, citing as examples an attempted attack on an FBI office in Ohio three days after the Mar-a-Lago search and the more recent arrest of a Trump supporter accused of threatening an FBI agent who investigated President Joe Biden's son, Hunter.
"Deploying such knowingly false and inflammatory language in the combustible atmosphere that Trump has created poses an imminent danger to law enforcement that must be addressed before more violence occurs," prosecutors wrote in a court filing on Friday.
Trump's lawyers say they've failed to show that his comments have directly endangered any FBI official who participated in the Mar-a-Lago search.
"Fundamentally, the motion is based on the fact that President Trump criticized the Mar-a-Lago raid based on evidence from publicly filed motions in this case, as part of his constitutionally protected campaign speech, in a manner that someone in the government disagreed with and does not like," they said.
