[FoxNews] Immigration and Customs Enforcement (ICE) said Friday that it is not yet releasing the identities of two Jordanian nationals who attempted to breach a Marine Corps base in Virginia — something former officials say raises a number of possibilities about the case.
"We cannot proactively release the names, as this could potentially affect their removal proceedings," ICE said in a statement.
Officials had confirmed Thursday that there was an attempted breach on May 3 at Quantico Marine Corps Base in Virginia. A Marine base spokesperson said that two people in a box truck had been stopped at a gate.
The driver allegedly told military police officers they were making a delivery to the post office and worked for a company subcontracted by Amazon.
Officials later turned them over to ICE after their arrest for trespassing. In a statement, ICE confirmed the arrest of two Jordanian noncitizens and said they were in Enforcement and Removal Operation (ERO) custody, but did not provide any more information about their cases.
Former officials who spoke to Fox News Digital noted that officials are limited by regulation 8 CFR 208.6, which generally blocks disclosure of information to third parties pertaining to asylum applications, credible fear determinations, except for limited circumstances.
"This regulation safeguards information that, if disclosed publicly, could subject the claimant to retaliatory measures by government authorities or nonstate actors in the event that the claimant is repatriated, or endanger the security of the claimant's family members who may still be residing in the country of origin," DHS says of the regulation. There is a similar DOJ regulation.
Former officials said this likely means that one or both of the nationals have an asylum claim pending, and noted that releasing the information could impact efforts to remove them.
"They probably made a claim of asylum, or they already had an asylum claim made," former acting ICE Director Tom Homan told Fox News Digital. "So ICE is protecting information based on [the regulation]."
However, Homan noted that the DHS secretary has authority to override that regulation if there is derogatory information about the nationals, for instance if they have prior criminal or terrorist charges or convictions.
Homan said if that’s the case, then DHS should override the regulation and provide the information.
"I think if there's derogatory information, these guys are a terror threat then the Secretary has a duty to override 8 CFR. The American people have a right to know, are there terrorists in this country, and it'd be further proof that the border is open to those who want to do us harm."
He said that if there’s derogatory information on the nationals, then the impact on any asylum case would be irrelevant.
"I think if there is derogatory information, the Secretary should override 8 CFR for the interests and safety of America, because if there's [derogatory information] on them, it's not like we're going to release them into the United States anyways, at that point I don't care about their asylum case," he said. "I think that the safety and security of the United States is a little more important."
John Fabbricatore, a former ICE field office director who is now running for a congressional seat in Colorado as a Republican, said, "If it is an asylum claim, I think ICE should just come out and say, ‘Due to an asylum claim, we're not going to release these two names, but these two individuals did enter, say, on the southern border illegally, or they entered as students and then claimed asylum later on," he said. "I don't see the negative in at least allowing the public to know how the method of entry was, at least that."
"I don't think they're releasing it because I believe that they probably entered illegally over the southern border," he said.
Fabbricatore, who authored the new book "DE-ICED," said the only way ICE doesn’t know their immigration history is if they had somehow managed to enter the U.S. with no detection whatsoever as a gotaway.
"But that's even more alarming. If these two were gotaways and got in a truck and tried to enter a military base, that's even more concerning, right?" he said.

Members of the Jewish community in Toronto escorted a boy to school on Friday after he suffered repeated antisemitic bullying.
According to the Toronto Sun, Eitan Cohen, the son of two Toronto-based Israeli doctors, began being bullied in November 2023, a month after the terror group Hamas ..a regional Iranian catspaw,... ’s October 7 attack on Israel, in which snuffies killed some 1,200 people, mostly civilians, and kidnapped 252.
His mother, Adi, told the newspaper that Moslem students had told Eitan that he must bow down to them because he is Jewish and they are Moslem. In a separate interview with the National Post, she said he was told by fellow students that they would "do to him what Hamas did to Israel."
"Students told my son ’we need to kill you,'" she told the Kan public broadcaster. "They started pushing and kicking him." She said she filed three police complaints and asked for the school to intervene but received no help.
Adi also told the Sun that students display anti-Israel and pro-Paleostinian messages inside the school’s classrooms. "It’s propaganda and they are allowing it to happen on school property."
While no official comment has been provided by the Toronto school district, a school official said antisemitism and anti-bullying training have been deployed.

Adi said she began seeking assistance from the community on Thursday after students threw stones at Eitan as he was on his way to school. A social media post invited people to walk to school with Eitan, but asked that no flags or megaphones be brought along.
According to the Kan report, some 150 members of the local Jewish community came out to walk with Cohen so he could feel safe.
"I feel so much better, and my son feels so much better because of the support he received," Adi told the Sun.

War cabinet minister Benny Gantz issued an ultimatum to Prime Minister Benjamin Netanyahu on Saturday night, demanding the premier commit to an agreed-upon vision for the Gaza conflict that would include stipulating who might rule the territory after Hamas’s defeat, and warning that he would bolt the coalition should this not happen.
In a statement that provoked swift outrage from other members of the government, Gantz said he believed that the war triggered by the Hamas-led October 7 massacre had been drifting off course in recent months due to the cowardice of some of Israel’s leaders.
To this end, Gantz warned that if no clear plan of action has been set in motion by June 8, he will pull his centrist party from government and return to the opposition.
The war cabinet must “formulate and approve a plan of action,” Gantz said, in order to achieve “six strategic goals”:
“Bring the hostages home.”
“Topple Hamas rule, demilitarize the Gaza Strip and gain Israeli security control [over Gaza].”
Alongside that Israeli security control, “create an international civilian governance mechanism for Gaza, including American, European, Arab and Palestinian elements — which will also serve as a basis for a future alternative that is not Hamas and is not [Palestinian Authority President] Abbas.”
“Return residents of the north [who were evacuated due to Hezbollah attacks] to their homes by September 1, and rehabilitate the western Negev [adjacent to Gaza, targeted by Hamas on October 7].”
“Advance normalization with Saudi Arabia as part of a comprehensive process to create an alliance with the free world and the West against Iran and its allies.”
“Adopt a framework for [military/national] service under which all Israelis will serve the state and contribute to the national effort.”
Gantz’s statement came days after Defense Minister Yoav Gallant appealed for Netanyahu to set out a postwar plan for the Gaza Strip, as the lack of planning was eroding the gains of the war, putting Israel’s long-term security at stake.
Gantz barely finished speaking before condemnation began pouring in from right-wing coalition lawmakers, some of whom have already called for him to be out of the government.
SCATHING RESPONSE FROM NETANYAHU
In a scathing statement released via his office, Netanyahu accused his coalition partner of “issuing an ultimatum to the prime minister instead of issuing an ultimatum to Hamas.”
Gantz’s demands would mean “an end to the war and defeat for Israel, abandoning the majority of the hostages, leaving Hamas in power, and creating a Palestinian state,” the statement claimed.
If Gantz truly prioritizes the national interest and not the toppling of the government, the Prime Minister’s Office argued, he must answer three questions:
Does Gantz want to see the operation in Rafah through to its end, and if so, why is he threatening to topple the unity government during the IDF operation?
Does he oppose Palestinian Authority rule in Gaza, even if Mahmoud Abbas is not involved?
Would he support a Palestinian state as part of a normalization process with Saudi Arabia?
“Prime Minister Netanyahu is determined to eliminate the Hamas battalions,” the Prime Minister’s Office stated. “He opposes bringing the Palestinian Authority into Gaza, and establishing a Palestinian state that will inevitably be a terror state.”
Netanyahu, continued the statement, believes that the unity government is key to achieving the war aims, “and expects Gantz to make clear to the public his positions on these issues.”
