Strasbourg Court, Ankara guilty of Dink's death
The European Court of human right today ruled against Turkey because it failed to protect the life of Hrant Dink, the Armenian journalist killed by nationalists on January 19, 2007. Turkey was also ruled against for having violated Dink's freedom of speech, sentencing him for insulting Turkey's identity. The Court then ruled that Ankara will have to pay 100,000 euros to Dink's family for moral damages.

In their ruling, the Strasbourg judges emphasised how the facts not only prove that Turkey's law enforcement authorities, which were informed about the imminent murder, did nothing to protect the journalist, and that, despite evidence against them collected by justice and investigation authorities, there was no trial. The Court then claimed that Ankara violated article 2 of the European Convention on human rights which sanctions the right of life, both in substantial and in procedural terms. The judges also ruled against Turkey for having violated Hrant Dink's freedom of speech.

The Court stated that not only Ankara would have trouble proving that its ruling was provided by the law or that it pursued a legitimate purpose, but above all that it was needed in a democratic society.

DPRK says South Korean investigation result over Cheonan provocation
(Xinhua) -- The Democratic People's Republic of Korea (DPRK) has labeled the final report of the South Korea's investigation into the sinking of its warship, the Cheonan, as provocation.

The official news agency KCNA reported Wednesday that the Secretariat of the Committee for the Peaceful Reunification of Korea published a bulletin, saying the South Korean report was a death struggle to save its diplomatic failure on the event, block the rising voice for improving north-south relations and escape from the domestic and overseas political crisis.

DPRK proposes military talks with SKor
(Xinhua) -- The Democratic People's Republic of Korea has proposed to hold military talks with South Korea, Yonhap news agency quoted military authorities in the South as reporting on Thursday.
"Don't forget to bring lunch!"
Pyongyang Wednesday suggested the working-level talks via a military communications line at the border truce village of Panmunjom, according to Yonhap.

In a related development, on September 8, the DPRK released the South Korean fishing boat "Daeseung 55" and its crewmembers that it captured last month for violating the DPRK's exclusive economic zone. Pyongyang also offered to hold a new round of reunions for separated families and accepted rice and cement for flood victims in the DPRK from Seoul.

Low support for radicalism among Euro Muslims: report
[Dawn] Support for radical groups is low among European Mohammedans and some leading groups with overseas roots are now cooperating with local governments and encouraging Mohammedans to vote, according to a new report.

European groups linked to wider Islamist movements such as the Mohammedan Brotherhood and Jamaat-i-Islami now focus more on conditions for Mohammedans in Europe than their original ideologies from Egypt and Pakistain, according to the report by the Pew Forum on Religion and Public Life.

The report also cited tensions between "jihadists" and peaceful Islamists in Europe, saying some groups linked to the Mohammedan Brotherhood were working with police to counter bad boys.

"By most accounts, support for radical Islamic myrmidon groups is relatively low among Mohammedans in Europe," it said. "Nevertheless, such groups have been central to the public discussion of Islam in Europe, especially in recent years."

The report said supporters of European groups with links to foreign Islamist movements often showed little interest in their founding ideologies, which critics say are radical and anti-Western.

Although some groups promoted bad boy views, others dealt only with religious issues or education, making it difficult to generalise about Mohammedan organisations in Western Europe.

The report said several Islamic groups with foreign roots had changed their focus to European issues because of pressure from younger European-born Mohammedans with fewer links to the Mohammedan majority countries their families emigrated from.

"Many of the younger leaders are pressing for an agenda that focuses on the interests and needs of Mohammedans in particular European countries rather than on global Islamic causes, such as the Israeli-Paleostinian dispute," the report said.

It said most of the movements, including the politicised ones, such as the Mohammedan Brotherhood, encouraged their followers to participate in local and national elections in Europe.

Some leading Mohammedan groups in Europe are loosely linked to the Mohammedan Brotherhood from Egypt, including the Union of French Islamic Organisations (UOIF), Mohammedan Association of Britain, Islamic Community in Germany and Intercultural Islamic League of Belgium, according to the report.

The Turkish group Milli Goros and Pakistain-based Jamaat-i-Islami have similar Islamist roots, it said.
These groups have been working more closely with local governments since 2001, responding to efforts by officials to engage more with Mohammedan populations. Some have joined with domestic opposition groups to protest against the war in Iraq.

A large but little known group is the religious movement of Turkish Islamic scholar Fethullah Gulen. It is strongest in Germany, with a dozen schools and over 150 cultural centres.

The Saudi-financed Mohammedan World League and World Assembly of Mohammedan Youth seems to be losing influence because their strict Wahhabi Islam has little appeal in Europe, the report said.

Groups practicing Sufism, a more mystical style of Islam, make up a widespread minority among European Mohammedans, but they are not centralised and often shun political activity.

A British government effort in recent years to promote a Sufi council to counter radicalism "has been widely viewed with suspicion by British Mohammedans," it said.

Even if one was to believe this report, then they must also admit that at some point social service programs are merely paying people to obey the law. Which makes continuous conflict not only possible but profitable. Which makes it an industry. Which is what Ike was warning about.

Appeals court considers release of Gitmo detainee
The Obama administration has appealed an order for the release of a Gitmo detainee charged with helping recruit some of the Sept. 11 terrorists. A lower court judge said that Mohamedou Ould Salahi should be set free because he was abused and later retracted his admission of helping to make travel arrangements for two of the hijackers.
Wonder how half-hearted the 'appeal' will be ...
Salahi admits that he fought with al Qaeda in the early 1990s to oppose the Soviets in Afghanistan. But he claims to have stopped fighting for them before they turned against the US.

Judge in Hasan Case Refuses to Close Courtroom
Following a brief hearing at Ft. Hood this morning, Col. James Pohl refused a request by alleged Ft. Hood gunman Maj. Nadal Hasan to close Hasan's upcoming Article 32 hearing to the media, and to relatives of the victims.

Pohl, who is the hearing officer in Hasan's court martial, said keeping the hearing open would 'preserve the integrity of the military justice process.'

Hasan is charged with 13 specifications of premeditated murder and 32 specifications of attempted premeditated murder in connection with a shooting spree at a military processing center at the sprawling central Texas Army post last November.

The counts carry the possibility of the death penalty, but federal prosecutors have not yet said whether they will seek that punishment.

Defense attorney John Galligan says prosecutors are trying to 'rush his client to judgment.

"If the decision is made that the military-judicial process, the court martial process, is going to be used in a manner that disregards the defendant's rights, then get out of the way," Galligan said.

Today's ruling clears the way for Hasan's Article 32 hearing, which is the miltiary equivalent of a grand jury, to take place as scheduled at Ft. Hood October 12.

Under the Uniform Code of Military Justice, Pohl at that hearing, which is the equivalent of a civilian grand jury, will question the 32 people who were wounded in the incident, as well as other witnesses.

He will then rule on whether the case should proceed to a court martial, in which a panel of officers of higher rank than Hasan will act as the jury.

The Article 32 hearing may possibly be ongoing on November 5, which will be the first anniversary of the incident. If so, Pohl has indicated he will not hold court on that date.

Hasan, an Army psychiatrist, is paralyzed from the chest down due to four gunshot wounds he suffered at the hands of two civilian security officers who stepped in to stop his rampage, and he is housed in a special hospital wing of the Bell County Jail in nearby Belton.

He also continues to receive his full major's pay, of about $72,000 a year,s while he awaits court martial.

He's afraid somebody is going to call this berserk Muslim terrorist traitor exactly that. There's a lot of people out there who are deathly afraid of the 'Emperor-has-no-clothes' moment, and there's a good chance that this trial could provide one.

NOTE: In fairness, the guy's being a zealous advocate for his client. We don't have to like it, but he's doing his job by playing every card he can.

#5  Until the ritual of trial and conviction takes place, the standard of ".., nor be deprived of life, liberty, or property, without due process of law;.." applies. By act of Congress he is commissioned. He can not be 'decommissioned' till he's convicted and appeals finalized. Till such time the pay continues.

Muhammad row cartoonist 'in hiding on FBI advice'
A US artist whose satirical cartoon inspired an internet campaign inviting people to draw images of the Prophet Muhammad has disappeared into hiding, her newspaper has said.

Molly Norris, who disavowed the movement that provoked outrage in the Islamic world, has moved and changed her name, the Seattle Weekly said. She fled after FBI agents warned she was in danger, the newspaper wrote.

Depictions of the Prophet Muhammad (PTUI) are forbidden in Islam.

The Seattle Weekly wrote that Ms Norris was "moving, changing her name, and essentially wiping away her identity".

"She is, in effect, being put into a witness-protection programme," it said, but without government aid.

"She likens the situation to cancer," the paper wrote. "It might basically be nothing, it might be urgent and serious, it might go away and never return, or it might pop up again when she least expects it."

Told by agents to keep an eye out when in public, the paper said Ms Norris responded: "Well, at least it'll keep me from being so self-involved."

In her cartoon, Ms Norris satirically proposed 20 May as an "Everybody Draw Muhammad Day".

The idea inspired a separate Everybody Draw Muhammad Day group on Facebook which rapidly grew in popularity. The page contained drawings and cartoons of the Prophet Muhammad (PTUI) and characters from other religions, including Hinduism and Christianity.

It sparked outraged protests in Pakistan, where a court ordered Facebook to be blocked

#5  Big institutions in the US, institutions whose core activity is free expression no longer believe that the US Constitution is the real law of the land anymore. This includes Yale, nearly all mainstream news TV, mainstream newspapers, educators like Yale, entertainment like Comedy Central, even the Metropolitan Museum of Modern Art.

I don't think their reason for not violating Sharia is some multicultural piety. I believe their reason is a very realistic fear of punishment.

The question now is whether the political class is willing to change course. Whether they're willing to tell certain countries and certain peoples that constitutional freedoms are not negotiable that there's no room for compromise, even in the face of Armageddon. Western style freedom in Western countries had never been an issue.

A few decades ago that point was made very clear to an adversary controlling a huge conventional and nuclear military force.

This isn't about a presumably leftist Seattle artist, or about an embarrassing, uncouth, evangelical bitter clinger in Florida, or a danish cartoonist etc. It is about all of us, our freedoms our western way of life.

For example, speak up and the dems dig into your past and slander you, or send the IRS after you, or get your boss to fire you, or just get threatened with violence. This is whats happening across the board. Not just with Islam. Burn the Koran and get fired, ask The POS prez a question like Joe the plumber did and get attacked from all sides. Speak out like Palen did and get hit with hundreds of frivolous law suits, and on and on. Our constitution is under attack, people must remain vigilant, or they will remain silent by force.

Musharraf to launch Pakistan party
[Al Jazeera] Pervez Musharraf, Pakistan's former president, is returning to politics in his country.

Speaking on the sidelines of an investor conference in Hong Kong on Wednesday, Musharraf said he will announce the establishment of his own political party, the All Pakistan Muslim League, in London on October 1 and outline his political platform.

He said he will return to Pakistan in time for the next elections scheduled for 2013 but would not say whether he would take part in them.

Musharraf stepped down from office in August 2008 amid nationwide protests and left the country soon after. He has since lived in self-imposed exile in London.

He played down any concerns about future legal action arising from his military rule.

"There are elements who are opposed to me, political elements. And they are the one who engineer these cases and launch cases in the subordinate judiciary. One has to face all that. I am prepared to face that for the sake of Pakistan. And I know since whatever I did had all the legal backing and legal cover, I am very confident that nothing can happen legally against me (when he returns home)."

He said he is confident of rebuilding his support base rooted in Pakistan's youth. He noted that more than 75 per cent of his 295,000 followers on Facebook are between the ages of 18 and 34.

"Therefore I know that it is the youth that is yearning for change. It's the youth that is demoralised today. And I know that they can be awakened and brought out to introduce a new political culture into Pakistan."

Musharraf became president after seizing power in a 1999 military coup. During nine years of his rule, Pakistan became a key ally of the US in its "war on terror".

(Xinhua) -- Israel is warning Hamas, always the voice of sweet reason, that it could return to a policy of "targeted assassinations" of the Islamist group's leadership in Gazoo and abroad if rocket strikes and armed attacks against Israel do not stop, Paleostinian newspapers and news agencies reported on Thursday.

According to the report, "diplomatic sources told Asharq ( beacon) that Israeli Prime Minister Benjamin Netanyahu asked the Arab countries to transfer a warning to Hamas that the resumption of armed hostilities and suicide kabooms, including inside Israeli cities and the escalation of rocket fire at Israeli territories would make Israel to return to what sources called a policy of assassinations and targeting the leadership and institutions in the Gazoo Strip and abroad."

Israeli Prime Minister Office front man Mark Regev told Xinhua on Thursday that he was aware of the reports, but would not comment on them.

Regev, referring to the last two days of intensive but discreet direct talks between Netanyahu and Paleostinian National Authority (PNA) President the ineffectual Mahmoud Abbas, including the U.S. Secretary of State Hillary Clinton and U.S. Middle East special envoy George Mitchell, said the discussions were confidential and would remain so.

Overnight, Israeli Air Force jets bombed what the army said was a weapons warehouse in northern Gazoo. The strike comes after a sortie on Tuesday against targets in Rafah along the Egyptian border that left one Paleostinian smuggling tunnel worker dead and several others maimed.

The "specific tunnel was used to smuggle Orcs and similar vermin into the Gazoo Strip so that they could execute attacks against Israeli civilians," the Israeli Defense Forces (IDF) front man said in a statement sent to Xinhua. The army said it "holds Hamas solely responsible for any terrorist activity emanating from the Gazoo Strip."

The airstrikes came after Paleostinians in the Hamas-controlled enclave fired at least a dozen mortars, Grad and Kassam rockets into Israel over the past several days. Israeli officials say it was the heaviest such barrage against Israeli civilian targets in the last year, since the army's Operation Cast Lead in the end of 2008. Officials said two of the mortars contained phosphorus.

The upsurge of violence comes against a background of peace talks held Tuesday and Wednesday between Netanyahu and Abbas.

Jouzo: Aoun is Defending Spies as Hizbullah Stands Idle
[An Nahar] Mount Lebanon Mufti Sheikh Mohammed Ali Jouzo slammed Free Patriotic Movement leader Michel Aoun and Hizbullah on Thursday for attacking security officials and the judiciary.
Aoun "is trying to protect Israel's spies in Lebanon, that's why he has launched a campaign against the (ISF) Intelligence Bureau ... which has unveiled the truth behind Fayez Karam, one of the most important FPM cadres," Jouzo said.

"It is strange for Hizbullah to stand idle or to support the general (Aoun) in his stances," he said.

Jouzo also accused the Shiite party of pushing former General Security Department chief Maj. Gen. Jamil Sayyed to attack Premier Saad Hariri and other officials in his press conference last Sunday to "obstruct the role of the international tribunal."

"Why is Hizbullah afraid of the court if it sure of its innocence?" Jouzo wondered.

Barak: Hizbullah Won't Surprise Us Again
[An Nahar] Israeli Defense Minister Ehud Barak said Thursday that Hizbullah won't surprise Israel again, in reference to the 2006 war between the Jewish state and the Shiite group.
Barak made his comment to reporters during a tour of an Israeli army base on the border with southern Lebanon.

The Israeli defense minister also expressed reassurance at the capability of Israel to overcome obstacles to achieve peace with Syria and Lebanon.

He said he backs the "political process" with Palestinians.
