Justice Ginsburg misses second day in a row at Supreme Court
[The Hill] Justice Ruth Bader Ginsburg was absent from the Supreme Court bench for the second day in a row on Tuesday.

Chief Justice John Roberts noted Ginsburg’s absence when the justices took their seats for the second time in the new year.

Repeating what he said Monday, Roberts said Ginsburg is "unable to be present" for the court’s sitting, but will participate in the decisions using transcripts of the arguments and court briefs.

Ginsburg, who was forced to miss her first oral argument in more than 25 years on Monday, is still recuperating at home after surgery to remove two cancerous nodules from the lower lobe of her left lung on Dec. 21.

The spots were found incidentally in an X-ray she had at George Washington University Hospital while being treated for fractured ribs, an injury she sustained after falling in her office on Nov. 7.

The Supreme Court said scans performed before surgery indicated no evidence of disease elsewhere in her body, and no further treatment is planned.

Ginsburg, 85, is known for her stamina, having already survived two bouts of cancer prior to this most recent diagnosis ‐ colon cancer in 1999 and pancreatic cancer in 2009.

#1 Don't know what the big deal is... she already knows how to vote. Legal arguments are a waste of time.

- Ok to deny scholarships to divinity students. (Feb 2004)
- Paying taxes sufficient to oppose religious tax credits. (Apr 2011)
- Disallow taxpayer funding for parochial school materials. (Jun 2000)

#3 Wow B., A lot of anti-religious decisions. Now that she is about to meet her maker, I wonder if she'll have a change of heart or just doesn't believe. Secretly, the left will never forgive her for not resigning under Champ's watch.

#4 Question is, at what point is a justice deemed incapable of performing the job and the seat to be filled?

Two months on life support?

I would say an appointment for life means 24/7 availability, a salaried position if you will, and missing 5% of a 365 day contracted position at least opens up discussion of breach of contract. Senate question.

#5 And the ads - the ads themself - are absolutely atrocious. Mostly the voicing, and who approved the voicing.

#6 Yeah, appointment for life was a huge mistake.

I would change it so each state appoints one judge for one year with the Vice President throwing the tie breaker vote if needed.

No chance to stack that court again and we don't have to deal with shit like this.

#7 Used to be that life appointment wasn't a very long time.

#9 The Dems will have her voting absentee ballot as soon as they think of it.

#10 I actually feel sorry for RBG. While I disagree with most all of her decisions, she's an 85 year old very ill woman that is getting pushed to stay by the Dems, hell they've even been fantasizing to give her a day of their own life to keep her propped up. She made the wrong decision for her party to not retire under Obama.
A blessing for us to get another Conservative SCOTUS in under Trump. After the s*** show of Kavanaugh, popcorn sales going through the roof.

#11 I'd be upset about the anti-religious rulings except that, sooner or later, tax money will end up being spent on mosques and madrases.

#13 I don't feel the least bit sorry for her. Eighty-five years is a good, long run and we all have to wrap it up sometime.

#14 I actually feel sorry for RBG, I don't agree with her left wing decisions, or outbursts against Trump, however this is an 85 yo woman in poor health that probably should have retired under Obama considering her left leaning politics. Hell the Dems are fantasizing about giving her a day of their own life to prop her up for Gods sake. To remain working probably isn't in her best interest right now but feels the strong push from Dem's to stay being the selfish bastards they are.

I don't wish her any harm, however, that being said, I believe we are blessed that we may get another Conservative SCOTUS appointed under Trump. After Kavanaugh my God it'll be a s*** show, I predict popcorn sales going through the roof.

#15 Don't know what the big deal is... she already knows how to vote. Legal arguments are a waste of time.

It's easier for her to frame her excuse for legislating from the bench if she knows what's gone down in court.

#16 She bet that Hildabeast would win so she could choose RBG's replacement. She chose poorly

#17 I don't feel sorry for her at all. She is as selfish as McCain, desperately clinging to power with no regard for the nation or her August office.

#20 I thought pancreatic cancer was very tough to beat, in part because it spreads?

Where is Dr. Steve when we need him?

#21 Pretty obviously she's a cyborg. The AI to knee-jerk left every decision is basic stuff. Even Sotomayor and Kagan have it down
