Court finds US improperly seized Islamic charity assets
US officials correctly designated an Islamic charity, Al-Haramain Islamic Foundation Oregon, as a supporter of terrorism but improperly seized its assets, a federal appeals court ruled on Friday.

The US Ninth Circus Circuit Court of Appeals ruled that the Treasury Department was correct in finding the organization connected to terrorism because one of its board members was designated by the Treasury Department as linked to terrorism and because the group financed such activities in Albania and Chechnya. But the appeals court found the department's Office of Foreign Assets Control improperly seized the charity's assets using a "blocking order" to freeze them without a warrant supported by probable cause.
If all that matters here is procedure, get a warrant and take their assets. Sorry, our bad! But it looks like the Ninth Circus thinks that there should be no consequences for being a supporter of terrorism.

#2  The Ninth Circuit Court is reversed an awful lot, as I recall. Also, and this doesn't seem trivial, it's been quite some time since the assets were seized -- to whom would they be returned?

India-Pakistan
Gen Kayani rebuffs US allegations
[Dawn] Pakistain's powerful military responded to accusations from the United States that its spy service was tied to a violent turban faction of the Afghan insurgency as "very unfortunate and not based on facts."

"While taking note of the recent statements made by Admiral Mullen, chairman joint chief of staff United States, Chief of Army Staff General Ashfaq Parvez Kayani
... four star general, current Chief of Army Staff of the Mighty Pak Army. Kayani is the former Director General of ISI...
, termed these as very unfortunate and not based on facts," the military said in a statement released on Friday night in Rawalpindi.

He said that the allegations are especially disturbing in view of a rather constructive meeting with Admiral Mullen in Spain.

"On the specific question of contacts with Haqqanis, the (chief of army staff) said that Admiral Mullen knows fully well which all countries are in contact with the Haqqanis. Singling out Pakistain is neither fair nor productive."
"We didn't do it. You can't prove it - and in any case, we weren't the only ones."
"And we'll never do it again."
Then his lips fell off.
Mullen, speaking in Senate testimony on Thursday, alleged Haqqani operatives launched an attack last week on the US embassy in Kabul with the support of Pakistain's military intelligence.

US urges Pakistan to break ties with Haqqanis
[Dawn] The White House urged Pakistain on Friday to break any links it has with the Taliban-affiliated Haqqani jihad boy network and to take action to shut down their safe havens along the Afghanistan-Pakistain frontier.

White House front man Jay Carney said the Haqqani network was responsible for the recent attack on the US Embassy in Kabul and other assaults in Afghanistan that have killed American troops.

He said the Death Eaters operate from safe havens in Pakistain that Islamabad has failed to shut down.

"It is critical that the government of Pakistain break any links they have and take strong and immediate action against this network so that they are no longer a threat to the United States or to the people of Pakistain, because this network is a threat to both," he said.

US can't live with or without us, says PM
[Dawn] Prime Minister Yousuf Raza Gilani
... Pakistain's erstwhile current prime minister, whose occasional feats of mental gymnastics can be awe-inspiring ...
on Friday said that the United States could not effectively fight the ongoing war in Afghanistan without Pakistain's assistance, DawnNews reported. "They can't live with us. They can't live without us," Gilani told news hounds in Bloody Karachi.
He's suffering from delusions of adequacy...
"So, I would say to them that if they can't live without us, they should increase contacts with us to remove misunderstandings."

The prime minister also emphasised that the US should avoid issuing statements unacceptable to the Pak public.

No compromise would be acceptable on Pakistain's illusory sovereignty, he said, adding that, a stable Afghanistan was in the interests of Pakistain.

Gilani was responding to Senate testimony by the outgoing chairman of the Joint Chiefs of Staff, Admiral Mike Mullen, who said Pakistain's Inter-Services Intelligence agency (ISI) was closely tied to the Haqqani network.

Mullen said on Thursday that the ISI played a role in the September 13 attack on the US embassy in Kabul, supporting Orcs and similar vermin known as the Haqqani network.

That network, Mullen said, is a "veritable arm" of the ISI.

Police tell CD sellers Stop `vulgar` business to keep Taliban away
[Dawn] After the Nishtarabad CD Market bombing on Monday, local police have advised shopkeepers of the market against selling compact discs and digital video discs of `vulgar` dances and dramas to prevent terrorist attacks by the Taliban.

Superintendent of Police, Beautiful Downtown Peshawar (City Circle) Imtiaz Shah told Dawn on Thursday that police had asked CD Market traders not to spread vulgarity.

"We`ve done our duty by asking them against selling vulgar CDs and DVDs and if that doesn`t happen, the Taliban would continue creating problems for them," the SP said.

Meanwhile,
...back at the mall, Clarissa spent the day shopping for new underwear. Tonight was going to be a special occasion...
a CD shop owner said on condition of anonymity that some shopkeepers were dealing in CDs and DVDs of vulgar dances and dramas to the anger of the Taliban.

He said the CD Centre Owners` Union had discussed the matter time and again but to no avail.

He, however, claimed after the Monday bombing, the union had decided to strictly crack down on such shopkeepers once the market was opened.

The shop owner said police had informed the union of possible attack by the Taliban a few months ago.

Owners of some grocery shops in the area also charged CD dealers of Nishtarabad Market with spreading vulgarity and demanded early relocation of their (latter`s) businesses for the safety of others.

Sabir Khan, whose general store was destroyed in the blast, said the people of the entire area were paying for the acts of the traders selling CDs of obscene material.

He said CD shops should be moved out of the market so that others in the area could do business without fear.

When contacted, President CD Centre Owners` Union Sher Dil Khan urged the government to check the quality of movie, dance and drama CDs and DVDs through a censor board.

He said traders wouldn`t stop selling offensive and morally harmful compact discs on their own.

"As for me and other office-bearers of the union, we hate vulgarity like anything and have always advised traders against selling vulgar CDs and DVDs," he said.

He, however, said the union had no authority to stop people from dealing in vulgar discs.

Sher Dil said the union office-bearers had several meetings with the relevant government officials but to no avail.

He said in the past, the provincial government declined to take corrective measures saying culture was a federal subject, but now after the decentralisation of the Culture Ministry, its inaction against the promoters of vulgarity was beyond comprehension.

The union president urged the government to realise its responsibility and proceed against those tarnishing the image of Pakhtuns and destroying Pakhtun culture.

The provincial information minister couldn`t be contacted by telephone despite repeated attempts.

Director Culture Department Pervez told Dawn that the province had to report any case of vulgarity to the Pakistain Electronic Media Regulatory Authority, which hadn`t been devolved by the Centre.

He said the censor board oversaw cinemas not cable network exhibiting CD programmes.

Iran Considering Attacking U.S. Facilities in Mideast
Destroying American military positions in the Middle East is the most effective method to get the "Great Satan" to abandon the region, Iran now believes.

The Iranian website [the Mahramaneh online website, which is close to Iran's supreme leader, Ayatollah Ali Khamenei] then concludes that if the Islamic Republic, quietly and without any media hype, attacks American installations throughout the region, the United States will have but two choices: either it will be forced to keep quiet and the media will freeze out the information, or it will be forced to go to war with Iran, in which case the war would then be out-and-out known to be a war between the Islamic Republic of Iran and the West and America.
Iran may be coming late to the game, if all the Iranian panics over American spy squirrels are believed, not to mention the occasional airplane full of Iranian generals unexpectedly falling out of the sky. Though the airplanes may merely be due to inshallah maintenance and a woeful lack of spare parts. But really, the time for them to worry is when everyone important over there suddenly gets a late-night telephone call on the unlisted phone number...

#3  Since Obama's reelection is anything but assured they must make their move about now if they want to create facts on the ground that cannot easily be changed by a new administration.

Gaddafi's demise should give them pause though. The Duck of Death was ideologically closer to Obama than the Mullahs (via Obama's neighbor 'Minister' Farrakhan.) And that didn't protect him ultimately.
