#3 They had. But if my memory doesn't fail me it is the Senate who approves appointments and the Dems had a majority there.

Your memory does not fail, JFM. In fact, the Democrats still do have a majority in the Senate. Whether they still will after midterm elections next November is apparently a question of some concern. But until then all sorts of things are simply not possible, including impeaching the president and walking back back Obamacare.

#5 ..however, the purse strings belong to the House. Only pass narrowly defined appropriations, basically taking a clever to government that this case amply demonstrates when it functions above/outside the law.
