#1 There have been a lot of Constitutional over-reaches in the last couple of decades or so. After all, the Founding Fathers are a bunch of dead white guys. What could they possibly know? Use of the term "Father" is old hat as well. (Is sarc necessary?)

#4 Didn't the SCOTUS 'discover' some 'community safety' exception in the Fourth Amendment a few decades ago that government can use to do pretty much anything it wants relative to warrantless search & seizure?
