Biden Pardons Fauci, Milley, Cheny, etc
[WTAE, h/t Twitchy] President Joe Biden has pardoned Dr. Anthony Fauci, retired Gen. Mark Milley and members of the House committee that investigated the Jan. 6 attack on the Capitol, using the extraordinary powers of his office in his final hours to guard against potential "revenge" by the incoming Trump administration.

Courtesy of Mike Kozlowski, Hot Air has a brief but interesting analysis of the impact and efficacy of these particular pardons.

#1 Not Merrick B. Garland? For failure to destroy Trump before the election?

#3 President Biden Preemptively Pardons General Milley, Anthony Fauci, and January 6 Committee Members

They may not be indicted but the Discovery process can be painfully grueling.

#10 Biden has no pardoned or commuted over 8000.

FDR did about 3700

Obama did about 2000

Andrew Johnson pardoned about 650 regular and about 7000 to ex Confederate soldiers and Confederate govt officials.

Carter pardoned several hundred thousand draft evaders but not by name.

Since Carter and except for Obama, no President has issued more than about 500.

#11 Copied from Instapundit:
The question of whether or not Biden can pardon himself is still up in the air. There is still a period of time left for him to pardon Kamala Harris, resign his presidency and for the newly selected President Harris to then pardon former president Biden.

#12 Yah know, pardons can be undone. It has just been curtesy that they haven't by other presidents. Time to go after these fuckers and Biden too.

Hang them all

#13 James Kunstler beat me to it by a few hours: "As I write, long before dawn, “Joe Biden” remains President of the US. You must wonder, as the hours dwindle to noon, what pardon power magic he’s saving for the final minutes of his term, while the whole nation is distracted by the spectacle in the Capitol Rotunda"

#15 Another copied post from IP:
One option to deal with Fauci, I copied this from the Maryland State Medical Board:
"License Number: D0004034 Dr. Anthony S Fauci
License Type: Physician-Medical Doctor
License Status: Active
License Issued: 10/02/1969 License Expiration: 09/30/2026"
If Fauci accepts his 'pardon,' thereby admitting he committed a crime, he can still be sanctioned by the MD medical board - cancelling his license for an admission to crimes. This is entirely a state issue and not one covered by a federal pardon. There is no federal licensure for physicians, last I checked.

#16 They need to charge them, get the Supreme's involved and get rid of pre-emptive pardons. If it fails charge some more until the figure out the argument to abolish it.

#19 He can pardon federal crimes. On going grand jury in Florida on COVID response is a state issue. IIRC recently SCOTUS ruled that state and federal prosecutions around the same action(s) do not constitute double jeopardy. There is also civil liabilities routes to seek redress.

Separately, while Mercutio has a point, I can see how a Russian would find badanov’s cartoon funny, after all the abuse they took from America’s deep state about that particular lie.

#24 Pardon aside - as Commander, which Trump is, he still should be able to recall Milley and discipline him via NJP. Pardon should not apply since it is non-judicial, crime not involved, strip him of his rank and clearance at a minimum. Make him thoroughly unemployable to the MIC.

#25 We shall soon be entertained by the Legal/Political classes opining upon the legality of "preemptive" pardons.

I suspect they are not and would not be troubled to see a number of recipients swaying in the wind.

#27 Subpoena them all to testify, under oath, and spill the beans. Since they cannot be prosecuted they no longer have a 5th Amendment privilege. So either they lie, and get prosecuted for perjury, refuse to talk, and be held in criminal contempt, or spill the beans so that everyone knows exactly why they needed pardons.

I also really like the idea of rolling up all the underlings and marching them off to jail. In their thousands.

#32 /\ Yes, "suspended" pending final investigation is nearly as good as revocation.

A Security Clearance is a "condition of employment" in D.C.

#33 By classifying the cartels as terrorist organization they become a belligerent. IAW the Hague Convention of 1907 "a neutral country has the obligation not to allow its territory to be used by a belligerent. If the neutral country is unwilling or unable to prevent this, the other belligerent has the right to take appropriate counteractions."

#35 Couldn't Milley now be compelled to testify on the exact nature of his communication with the CCP in all details, by Congress or as part of a prosecutor's investigation into related wrongdoing by parties who weren't pardoned.

I reckon he didn't just personally dial Zhongnanhai and said "Hello Jinping!" a la Dr Strangelove, so others would have been involved.
