Seattle man, 48, is arrested after standing outside Democrat Pramila Jayapal's house with a GUN and 'telling her to 'go back to India' ' - before being freed due to a 'lack of evidence'

Brett Allen Forsell, 48, was arrested outside Jayapal's Seattle home on Saturday

Police said he was standing in the street with a holstered Glock handgun

Jaypal had called 911 to report a man outside hurling obscenities

Neighbor claimed he said 'I'm going to kill you' and 'Go back to India'

But prosecutors say they're still seeking hard evidence of the slurs and threats

Forsell was released on Wednesday after no charges were filed after 72 hours

But he could still face state or federal charges as the investigation continues
