The Congress shall have Power To… exercise exclusive Legislation in all Cases whatsoever, over such District (not exceeding ten Miles square) as may, by Cession of particular States, and the Acceptance of Congress, become the Seat of the Government of the United States… (The U.S. Constitution, Article I, Section 8, Clause 17)

It can't be a state without an amendment. However, we apparently don't need an Article V change with our ~~rulers~~ SCOTUS.

#2 It's not likely that a Constitutional Amendment would pass muster.

After watching the riots in D.C., the district government is not ready for statehood. They cannot even protect the District and its inhabitants and its property from mob violence.
