#1 He [Circuit Judge Jon Newman] said it was no longer logical or plausible to argue that disclosing the legal analysis could jeopardize military plans, intelligence activities or foreign relations.

So tell me then, why does the gov't continue to argue the issue? Perhaps we will soon find out.
