Judge Denies NYC Subway Hero Daniel Penny's Request to Dismiss Manslaughter Charges
[Breitbart] A New York court has denied Daniel Penny’s request to drop involuntary manslaughter charges in connection with the death of Jordan Neely, a homeless man who threatened subway passengers before being subdued by the Marine veteran.

Penny, 25, was charged in the May 2023 death of Neely after putting him in a chokehold on a New York City train, claiming the mentally ill man “appeared to be on drugs,” and yelled threats like “I’m going to kill you! I’m prepared to go to jail for life and I’m willing to die.”

After Penny wrestled him to the floor, Neely was pronounced dead at the scene. The medical examiner later ruled it a homicide due to his neck injuries, the Daily Mail reported.

George Soros-linked Manhattan District Attorney Alvin Bragg charged Penny with manslaughter.

Penny’s defense team requested in October that the judge dismiss the manslaughter charges, doubting the medical examiner’s conclusion and highlighting the fact that Neely had synthetic drugs in his system at the time of the incident, which could have contributed to his death.

In addition to the drugs, Penny’s attorneys pointed out that witnesses also perceived Neely to be a serious threat, and that he had a long criminal history including violence.

“I’m sitting on a train reading my book, and, all of a sudden, I hear someone spewing this rhetoric,” one 60-year-old eyewitness told Fox News. “He said, ‘I don’t care if I have to kill an F, I will. I’ll go to jail, I’ll take a bullet.’”

The retiree said passengers were crowding around the exit signs and that they were all “scared for our lives.”

Neely had 42 prior arrests and an active warrant at the time of his death, Newsweek reported.

In a November 2021 incident, Neely attacked a 67-year-old woman, leaving her with a broken nose and black eye.

Despite mounting public support for Penny’s actions, Manhattan Supreme Court Justice Maxwell Wiley rejected the request for dismissal on Wednesday, ruling that the medical examiner’s assertion that the chokehold caused the death is enough to proceed.

Penny was also previously hit with a count of negligent homicide in addition to the involuntary manslaughter charge. He pleaded not guilty to both.

While many conservatives have raised money and spoken out on behalf of the young U.S. Marine veteran, Neely’s supporters have painted the issue as “racist.”

Trump offers defense of presidential immunity, cites Obama civilian drone deaths: 'He meant well'
[FoxNews] Obama was criticized for reported civilian casualties from drone strikes ordered during his presidency

Former President Trump objected to critics' arguments against presidential immunity, saying Thursday either himself or a future president could be stymied in urgent situations by circumspection around whether their executive actions might lead to punishment.

Trump told Fox News that, should presidential immunity be muted, when a president is taking unilateral actions as chief executive, the opposing political party could immediately begin strategizing how to prosecute their rival.

"I'm not talking about myself. I'm talking about [how] any president has to have immunity, because if you take immunity away from the president, it's so important, you will have you have a president that's not going to be able to do anything," he said on "Hannity."

"[W]hen he leaves office… the opposing party will indict the president for doing something that should have been good," he said, pointing to reports of mistakes or misfires made by his predecessor trying to eradicate terrorists.

"Obama dropped missiles and they ended up hitting a kindergarten or a school or an apartment house. A lot of people were killed. Well, if that's the case, he's going to end up being indicted when he leaves office."

A New York Times report from 2019 said the Obama administration had estimated between 64 and 116 civilians had been killed in 542 airstrikes.

In that regard, Trump said Obama "meant well," but suggested without presidential immunity, things might be different.

Trump later suggested Biden might have an even larger case for retaining presidential immunity.

"He's killed our country with his policies. The border is a disaster. Everything he does is a disaster. What he did in Afghanistan is the most embarrassing moment in the history of our country… " Trump said.

"Well, when he leaves office, if he doesn't have immunity — now, I think it's horrible what he did, but he probably, I don't know, it's hard to believe, but he probably meant well. It's hard to believe that he meant well."

Trump said Biden is at the least incompetent, but that presidential immunity protects the incumbent from being afraid to act because of fear of indictment.

He expressed confidence the Supreme Court will rule in favor of retaining presidential immunity, as he awaits verdicts in both Washington and Atlanta federal cases.

Critics have blasted Trump for his stance, with MSNBC journalist Jonathan Lemire claiming Trump is trying to "reverse-engineer a not-guilty [verdict] from the trials that he's facing, but also potentially try to give himself license to break whatever law he wants in a possible second term, to the point where it could even go to assassination."

"When Donald Trump tells us who he is or what he's going to do, we should believe him," Lemire said Thursday.

On "Hannity," Trump added that he is also confident the Supreme Court will overturn the removal of his name from the ballot in Colorado and Maine, pointing out that many other states where the prospect has come up have decided against stripping him from the ticket.

"I really believe they're going to leave the people to vote," he said. "You're the leading candidate in both parties. You're leading the Democrats by many, many points. I mean, it's hard to imagine they would do [it]."

Biden DHS spent counterterrorism funds on anti-conservative ‘counterpropaganda'
[Washington Examiner] While the Department of Homeland Security has allowed as many as 10 million immigrants to flood the southern border, the domestic surveillance state has prioritized something as a more important matter. According to documents unearthed by the Media Research Center, DHS paid $700,000 from a counterterrorism program to a self-described propaganda network to attack conservatives.

The source of the funding was the Targeted Violence and Terrorism Prevention Grant Program, which was created under President Barack Obama to target al Qaeda, put on hold, and then clandestinely revived by then-acting DHS head Kevin McAleenan and Miles Taylor, the infamous and insufferable "Anonymous" resistance within the Trump administration, with funding that "circumvented" the White House budgeting process. The beneficiary of the grant under President Joe Biden is the (already taxpayer-funded) University of Rhode Island’s Media Education Lab.

Trump prosecutor Fani Willis faces hearing on misconduct claims, tries to weasel out of grilling by alleged lover's ex-wife

The judge overseeing the Georgia election fraud case against former President Donald Trump has called a hearing over accusations that District Attorney Fani Willis and her lead prosecutor had an inappropriate relationship.

Fulton County Superior Court Judge Scott McAfee scheduled a hearing for Feb. 15 — and set a deadline for Willis to respond to allegations by Feb. 2 that she had an inappropriate relationship with special prosecutor Nathan Wade, according to a brief order from Thursday.

On the same day, her legal team also made a filing in the divorce case of the prosecutor, Nathan Wade, where she attempted to get out of sitting for a grilling by his ex-wife, who has been seeking to depose Willis.

Roman, who served as Trump’s director of Election Day operations in 2020, called for the judge to disqualify the entire prosecution team because of the alleged affair.

He also accused Wade — a private attorney with the Atlanta-based Wade & Campbell Firm — of using some of the nearly $654,000 in legal fees he collected from the Fulton County DA’s Office for his work on the Trump case to take Willis on vacations to "California, Florida and the Caribbean."

Willis’ lawyers also made a filing in the divorce case between Wade and his estranged wife, Joycelyn Wade, which has been ongoing since 2021.

Willis asked a judge to quash the subpoena for her testimony claiming the Wades’ marriage was "irretrievably broken" as early as 2017 — before she and Nathan ever met — and "after Joycelyn confessed to an adulterous relationship with [Nathan’s] longtime friend," the filing claims.

"There is no information that District Attorney Willis could provide that might prove relevant to granting or denying the divorce," allege the court documents filed by Willis’ lawyer Cinque Axam.
Apparently, not the Cinque in the Symbionese Liberation Army. He daid.
Joycelyn’s bid to depose Willis — which was filed the same day Roman filed the affair allegations as part of his effort to get out of criminal charges — is only meant to harass Willis and "damage her professional reputation," Axam wrote.

The lawyer even went as far as to allege Joycelyn had "conspired with interested parties in the criminal election interference case" to "coordinate" filing court papers in the two cases, all to try to embarrass Willis, in the filing.

Joycelyn’s actions are "obstructing and interfering" with the criminal matter and the deposition would be "overburdensome" for the DA, the filing claims.

Willis’ lawyer notably chose not to address whether Willis and Wade’s relationship occurred, and if they are indeed still together.

In a speech at Big Bethel AME Church on Sunday, Willis called Wade "a great friend and a great lawyer" along with a "superstar," but failed to mention him by name. She also suggested the accusations against Wade were race-related.

Legal Blow: Hunter's Defense Hammered by Discovery of Cocaine on Gun Pouch
[JonathanTurley] Attorney Abbe Lowell has faced a series of legal blows in his defense of Hunter Biden, but not quite as literal or lethal as what came this week in his client’s gun prosecution.

After Lowell sought to dismiss the federal indictment as a trumped-up political prosecution, the Justice Department lowered the boom and revealed that Hunter’s gun was found in a pouch covered in cocaine. The disclosure is devastating for a defense that Lowell just rolled out late last year.

Conservative activists who served in the Trump administration have launched an investigation into the FBI, accusing it of sidelining white men recruits in its five-year blitz of hiring women and minority agents.

America First Legal (AFL), a conservative action group, this week filed a Freedom of Information Act (FOIA) request, urging the agency to release the communications of its Chief Diversity Officer, Scott McMillion.

The group, which was founded by Stephen Miller, a White House advisor in the Trump administration, says McMillion's public statements and the FBI's diversity goals point at 'unlawful and unconstitutional racial balancing' in the agency.

The request comes as public support for the FBI plummets, especially among conservatives, who accuse the bureau of a liberal bias, politicization, and even of instigating the January 6 riot at the US Capitol in 2021.

The bureau between 2018 and 2023 boosted the 'racial/ethnic diversity' of staff by 5.4 percent, while increasing the share of female employees by 4.1 percent.

Even then, the agency's staffing did not reflect the make-up of the wider population.

In public statements, McMillion has said that FBI is engaged in a 'cultural shift' by prioritizing the hiring of more women and minorities into the bureau, the AFL says.

Democrat Rep Calls for Statue of Liberty Torn Down to Protest GOP's ‘Bigoted' Immigration Law
Big talk from a little man.
[SLAY] A radical Democrat congressman has called for the Statue of Liberty to be torn down in protest of the Republicans’ border security bill.

Rep. Maxwell Frost (D-FL) is demanding that one of the nation’s greatest monuments be removed to protest the House GOP’s H.R.2, also known as the Secure the Border Act. The comprehensive border security and immigration bill was passed in May last year.

On Wednesday, Frost told Republicans to pass a bill to remove the Statue of Liberty along with their "bigoted" immigration law. Frost issued the demand during a House Oversight and Accountability Committee hearing on immigration.

The bill would restrict the asylum process for people crossing the border and require resumed construction on the border wall.

The freshman congressman was one of many Democrats who attacked the bill. However, Front was widely mocked on social media after he produced a bill to remove the Statue of Liberty for Republicans to also pass.

"My colleagues from the other side of the aisle, let’s be honest with immigrants who deserve better than what you’re offering them," Frost said, holding up the draft.

"Don’t welcome immigrants if you plan to reject them.

"If you keep pushing your bigoted H.R. 2 bill, then also pass this bill.

"I’ve taken the liberty of drafting it for you.

"It removes the Statue of Liberty, our largest symbol that tells people to come here."
