In 2009 "Barack Hussein Obama" would be in power for 8 years and surrounded himself with Liberals Judges and SCOTUS justices.

Plus The 111th United States Congress:
* Senate majority was Democratic.
* House majority was Democratic
* Senate President was Joe Biden (D)
* The House Speaker was Nancy Pelosi (D)

Now, given who was running the DC show in 2009+.
How many think the death penalty would have been used ?

Not a civilian matter. Clearly involved Geneva convention violations. I recommend a military court.
