#1 Sure, blame it on the Israelis, when if it were not for Hamas, those people would not be at risk as captives in Gaza. The Geneva Conventions forbid holding civilians as captives for ransom or as human shields.

I'm sure there's special exception in UN rules for anyone fighting Israel.
