#1 The federal system designed by the Founders. Only enough centralization that is necessary for security and commerce with decentralizing as much as you can to prevent tyranny. Time for everyone to reread the Declaration of Independence.

#2 That is what is at the heart of the entire conflict. The socialists want lawfare, it's that simple. There are no doubt some number of useful idiots in the streets and others tweeting their Hollywood fingers bloody who are true believers, even if burdened with low reading comprehension.

But based on an adult reading of primary source documents rather than the aforementioned tweets, any substantive due process decision IS demonstrably erroneous.
