#1 perjury may be

however, making 'not doing your job' an actual criminal violation is a bit scary

#2 So, the city/county cannot be sued when a police officer performs a discretionary function, but the city/county can go after a police officer for not performing a ministerial function...correct?

#3 the rules for when and how to sue govt are really, really complicated and different for every jurisdiction

there are usually strict limits for statue of limitations (the Parkland shooting was almost 18 month ago and probably a civil suit against Peterson is out of the question by now) and every person being sued gets a specified notice of what you claim they did wrong

In Florida,

well, that, 'not doing your job', has been actively promoted by JAG officers in the WOT, by avoiding the requirements of Article 99 of the UCMJ.

#5 Unfortunately, it's very difficult to criminalize cowardice- at least civilian. A reprehensible individual to say the least. Likely his only punishment, other than his conscious -if he has one - is to be universally shunned where ever he goes. We might have to settle for that.

#6 Article 99 of the UCMJ is Misbehavior in the presence the enemy

#7 It is clearly not a case of cowardice in the face of the enemy. Even if he should have gone in just "gone in" like Delta Force, he didn't. He is a coward. Im not convinced he is a criminal. All the firefights I have been in were a surprise or something that our side started.

#8 The supreme court has ruled over and over that the police have zero obligation to protect you. So this won't go anywhere. And I kind of agree that the police are NOT the military, they aren't under the same obligation. By that token, they shouldn't have the qualified immunity that they do.

And should someone administer baseball bat karma to his nads, well that'd just be too bad. (Not saying I would do it or encourage it. Just wishful thinking)

#9 The police by Peel's principles definition should have no extra powers over a normal civilian.

Sorry for being too obtuse. The JAGs have undermined Art 99 in combat situations. They are big sponsors of do nothing that might bring bad press. They refused to scream that under the Conventions, the enemy using human shields are the ones violating them. You shooting through them at the bad guys is not.

As to officer jerk, the whole process will be expensive. Probably enough to eat up his pension. The process is the punishment.

#11  The supreme court has ruled over and over that the police have zero obligation to protect you.

So there is no need for them or their costs. Fully justifies a fully armed citizenry.
