This is someone engaged in warfare against the United States. You don't fight wars in a courthouse.

We're trying this guy here for the same reason that we brought Colombian drug dealers to trial here - they can't bribe/threaten the judges/guards to let them out of prison here. They can in Afghanistan.

I can think of any number of responses to that behavior that don't involve the courthouse
