#2 Thks CS - as it points out: don't believe your ambulance-chasing attorney. A gun legally sold and illegally used is no cause for suit in the first place. Attn: ACLU, NAACP - when you have pay the consequences of your mispersecution, you may understand legal rights/consequences of malicious suits - enjoy!

#3 She should have sued the family that allowed that child to have access to the gun.

Torts usually go after the deepest pockets. She was just taking a stab at the litigation lottery. Suing the child's parents wouldn't have gotten here any real compensation.

Was it wrong for her to sue the manufacturer? Yes. Was it stupid? No Would suing the family have gotten her any compensation even if she had won? No.
