#3 This may only be a portion of the Executive Order 12333 (prohibition of collection against US Persons) skirting. Unless I missed something, nothing in here about foreign intelligence agency assistance.

I believe the enabling of foreign intelligence agency activities against US persons could be characterized as espionage.
