#2 ..nah. The court system just ignores the double jeopardy clause when they want to. They've granted themselves the power to skip Article 5 amending process through interpretation. Go back to the LA cops acquitted in the Rodney King beating. The game is to divide all aspects of any alleged crime into discrete multiple crimes. Fail on one, so prosecute on another. The original intent was 'the crime and all associated lesser and associated crimes' for one shot. Where's the power in that?
