#5 the Russia Gate issue is being investigated by the DO'J

Biden's role in the Ukraine is a different matter and would require the Dept of State to provide info as well as the various govt offices in the Ukraine. This would have to be done prior to any DOJ involvement. At this point what Biden did appears to be sneaky and despicable and almost unreported but also legal.
