#1 ...they didn’t have a preliminary hearing in the 10-day time frame required by New Mexico State law for defendants held in custody.

Local DAs are elected too. Guess he/she didn't want to do the job.

#2 Not surprising at all if you had been paying attention.
The Judge was compelled by state law.
I would guess that the DA either refused to hold the hearing or was prevented from doing so - perhaps some three-letter-agency was holding onto the evidence?
They sure had no problem destroying the camp quickly.

This whole thing smells fishy. Even without a tinfoil hat.

#10 This one rests fully on the prosecution. They knew they had a deadline and blew it, leaving the judge absolutely no choice, the law was quite cleear. DA deserves a kick in the nuts and a boot in the ass on his way out of office. DA sheer incompetence, or maybe malfeasance - you decide.
