#2 This is nothing other than a power play, so the court should subvert it by permitting fatwas to be introduced in the manner of a "friend of the court" brief, submitted by the attorney for the religious scholars, but leaving the final decision up the the court.

That nails them in several different directions. First, it takes away any direct powers they have. Second, their brief must be in legalese, not in Koranic doublespeak. Third, it must be presented by an officer of the court, their attorney, not one of them. And fourth, the court is not bound in any way by what they said.

#3 This is what makes Islam incompatible with democracy. These clerics want the kind of power that, in a democracy, is only granted to elected officials and their appointees. But the clerics don't want to stand for election...they might lose.
