Did Sullivan show bias? Was a mandamus an appropriate way to resolve the claim of bias? Should Sullivan have acted as an umpire who adds more innings? Did Sullivan follow the law as established by SCOTUS? Did Sullivan act appropriately by trying to appoint Gleeson to act as what is essentially a special prosecutor. Did Sullivan act properly by establishing an amicus process to gather more information to decide whether or not to dismiss the non-case of the Justice Department? Was exculpatory Brady material withheld from Sullivan's?

#3  Seems that way magpie. There is a tortured interpretation of the law by the appeals court which seems only to protect Sullivan from what Is a "very hard slap for judicial abuse in the appeals court" and to insert more delays into the judicial process. There seems to be little recognition of the earlier decision made by the panel of three judges.

I'm reading comments in other places and in stories about the ongoing hearing. They are not very favorable towards the D.C. District Court of Appeals. I doubt that they care.

More of "Show me the man and I'll show you the crime." Lawfare at nearly the highest level.

#4  Back before the fall of the Roman Empire, or something like that, a federal judge in my corner of the world had a case against what we would now call a black activist pending before him. Probably after a cocktail or two, that judge was heard to say "I'm going to get that [African-American]." His impartiality was reasonably called into question, and a second federal judge (a really great one) chose to disbelieve the first judge's denial. Story here. Other than the races being reversed and Judge Sullivan being a touch more subtle about his intentions, I don't see much difference.

#6  Aside from affording Sullivan protection from the overt scolding as a partisan operative in this case, the judges seem likely to scurry to find a thread to return this case to Sullivan for more delaying tactics, while keeping the gag order in effect as long as possible. The are desperate for a Pardon by Trump to use for ammunition in the upcoming election as a proof of both corruption and a validation of the Russia-hoax ruse for just a little while longer. Another institutional veil slips and the clarity that Washington is so much more like Imperial Rome besides the neo-classical architecture remnants built when we were a confident, proud and united nation.

Then Barr just double dog dared them. If and when he releases it, it will further erode any legitimacy of the courts if they continue to play this game.

"While President Trump declares that 'it is what it is,' it is clear that the Trump administration and Republicans have completely failed to get this virus under control, which has resulted in devastating economic impacts," Hoyer said in a statement. "I continue to urge Republicans to work with us to take immediate action to provide desperately needed relief during this coronavirus pandemic before we can begin the August district work period."

Late last month, House leaders canceled its traditional August recess and said the chamber would remain in session in anticipation of a deal on the next coronavirus relief package. But talks between Democratic leaders and the White House deadlocked Friday, and President Trump rolled out a series of executive actions over the weekend to circumvent Congress.

The orders cover four areas: extending supplemental unemployment payments of $400 a week, providing student loan relief to borrowers, halting evictions and deferring payroll taxes. But the action is expected to be challenged in court, and it's unclear whether states will sign on to Mr. Trump's plan for the federal government to provide $300 in weekly unemployment benefits and states to provide the final $100.

[FoxNews] Fox News senior meteorologist Janice Dean, who recently lost her elderly in-laws to COVID-19, told the “Brian Kilmeade Show” on Monday that she was taken off the list to testify at a hearing geared toward understanding why and how the pandemic took root in New York nursing homes.

She said she believes New York Gov. Andrew Cuomo or his administration were behind the decision.

In a statement sent to Fox News Senate Majority Communications Director Mike Murphy said, "There are so many families that suffered because of this awful pandemic.

“We had so many brave families that wanted to share their heartbreaking stories including the ones that testified today and at last week’s hearing,” he continued. “As was made clear if you couldn’t testify in person we will accept all written testimony to be part of the written record.”

New York’s coronavirus death toll in nursing homes, already among the highest in the nation, could actually be a significant undercount. Unlike every other state with major outbreaks, New York only counts residents who died on nursing home property and not those who were transported to hospitals and died there.

That statistic could add thousands to the state’s official care home death toll of just over 6,600. But so far the administration of Democratic Gov. Andrew Cuomo has refused to divulge the number, leading to speculation the state is manipulating the figures to make it appear it is doing better than other states and to make a tragic situation less dire.

How big a difference could it make? Since May, federal regulators have required nursing homes to submit data on coronavirus deaths each week, whether or not residents died in the facility or at a hospital. Because the requirement came after the height of New York’s outbreak, the available data is relatively small. According to the federal data, roughly a fifth of the state’s homes reported resident deaths from early June to mid July — a tally of 323 dead, 65 percent higher than the state’s count of 195 during that time period.

More than 100 arrests were made, and 13 officers were hurt during the unrest, Chicago Police Superintendent David Brown said during a presser Monday morning.

"It almost sounds as though you’re saying this is — the reason [this is happening] is because the courts and the prosecutors were not doing their job, that they’re going too easy on the looters from the last time around," a news hound asked during a presser with Lightfoot and Brown.

Brown began to respond but was cut off by Lightfoot, who accused the news hound of trying to "bait" them with the question.

"No, no, don’t — do not bait us," Lightfoot said. "Do not bait us. This is a serious situation. People are concerned about their safety. Officers are concerned about their safety. So don’t bait us."

Lightfoot added that the city is aggressively searching to identify the people responsible for the unrest.

"When we do [identify them] and we do make those arrests, our expectation is that this is going to be treated with the level of seriousness that it should be, period," Lightfoot said. "Don’t try to bait us, mischaracterize, pit one against the other — we’re not playing that. We are in a serious situation here, and we need a serious response. That’s what we’re saying, period."

The question asked likely revolves around Cook County State Attorney Kim Foxx's decision last month to drop charges against hundreds of protesters who gathered in the city following the police killing of George Floyd in Minneapolis.

Foxx said at the time that violent mostly peaceful offenders, including some looters, would be prosecuted, but up to 817 protesters who had minor charges against them would get off scot-free.

Barr accuses media of 'projecting a narrative' in coverage of unrest: 'People are being told a lie'
[FoxNews] Attorney General Bill Barr accused the media of pushing their own "narrative" instead of reporting facts on the ground when it comes to coverage of civil unrest in cities across the country following George Floyd's death.

In an interview with Mark Levin on Fox News' "Life, Liberty & Levin," Barr lamented that while people are "rushing the police" and "throwing rocks," the media reports on "peaceful demonstrators" instead.

"They are projecting a narrative. When the word ’narrative’ came into currency I knew we were in trouble, because the word narrative suggests that there’s no objective truth," Barr said. "There’s no real story of what happened, it’s just everyone has their own narrative. And you get to where the press can justify presenting a story that doesn’t really correspond to objective truth but ’it’s our narrative, we have a narrative you have a narrative.’"

Barr went on to say that he was "appalled" by coverage of the violence because "it's happening right out in the streets," in public view.

"Anyone with eyes can see what’s happening. They see the violence, they see these groups of agitators in their black outfits, and their helmets, and their shields, which incidentally have the — have the hammer and sickle on them most of the time, rushing the police, causing violence, throwing rocks, people showing up with the rocks and frozen bottles," Barr said. "That’s happening. It’s happening in front of people."

Well yeah, this is what the MSM has come to. And those who watch MSNBC, CNN and the rest of these media outlets will swallow this slop. The MSM has been geared towards destroying Trump instead of reporting the truth. Truth has taken an extended holiday with the MSM in the U.S.
