| #4 Dept of Education and the Dept of Health and Human Services were created in 1980. Their functions were previously in the Dept of Health, Education and Welfare (HEW). Given that the Constitution doesn't mention Education as part of the Federal Government, there has always been a current that thinks these activities are unconstitutional. However, since the Commerce clause of the Constitution has been stretched and stretched, no serious challenges have been undertaken to challenge the constitutionality of the Federal Govt's role in Education. |
