Federal District Court Judge Orders Illinois to Show Examples of Every Newly-Banned Firearm |
2023-02-16 |
[TruthAboutGuns] Things just got very real for the gun-grabbers behind the Illinois Firearm Ban Act. Last Monday the Illinois Gun Rights Alliance filed for a preliminary injunction to block enforcement of the new gun ban in the Land of Lincoln. On Monday, the US District Court judge issued an order that sets up the Illinois Attorney General for an epic failure. We got an early Valentine’s Day gift. I say “we” because Guns Save Life where I serve as Executive Director stands as a named plaintiff in the FFL-IL lawsuit. As for the gift, US District Court Judge Stephen McGlynn issued an order requiring the state to provide illustrative examples of each and every item banned under the Illinois Firearm Ban Act. |

#9 Of course Illinois will just neglect to comply. |

#8 I think any ban that includes the trade name of a firearm must be unconstitutional on its face. In other words, there is nothing in the name that could make it legal or not, and if there is nothing else you can point to in terms of features, operations, size, etc. then your ban fails even intermediate scrutiny. |

#5 ..and won't effect the 'small' gun dealers who seem to have no problem in delivering guns to buyers in the small number of zip codes that create all the problems. |

#4 The judge's order goes beyond firearms and requires a listing of every component that will be banned as mere possession of components is barred by the law. Pistol grips, BCG, springs, muzzle devices must all be included in the states response. |

#3 Meanwhile, the smaller gun dealers who focus on rifles have nothing to sell... and no income. Wish more people recognized this as one of Pritzker's goals. His Illinois government has dollars to burn and will keep passing and litigating this kind of legislation while proclaiming its virtue to the foolish of Illinois. Which would be about 2/3 of the upstate population. |

#2 Now there is a cut and paste job from webpages. Of course you need to know the technology of the weapons so as not to include items which would tell the judge you don't know what the heck you are doing and are as mindless as the 'law' you are trying to defend. |

#1 With the exception of Mental Illness, a history of violence and/or physically harming others. Why is the Government even allowed to be involved? Given the clearly written US Constitutional Citizen's Right, SHALL NOT INFRINGE is any more needed to be said? |
