- Police said he was standing in the street with a holstered Glock handgun
- Jaypal had called 911 to report a man outside hurling obscenities
- Neighbor claimed he said 'I'm going to kill you' and 'Go back to India'
- But prosecutors say they're still seeking hard evidence of the slurs and threats
- Forsell was released on Wednesday after no charges were filed after 72 hours
- But he could still face state or federal charges as the investigation continues
