#1 Washington State Legal code RCW 9A.36.031 Assault in the 3rd Degree. (1)(g) Assaults a law enforcement officer or other employee of a law enforcement agency who was performing his or her official duties at the time of the assault... This is a 3rd degree assault and is a class C felony in Washington State. A 3rd degree assault charge comes with up to 5 years in prison and fines of up to $10,000. HOWEVER Having read the reports this should have fallen under RCW 9A.36.011 1st Degree Assault "Assaulting another and inflicting great bodily harm". 1st Degree Assault is a Class A Felony that carries a potential sentence of 7 to 10+ years in prison and fines up to $50,000 for a first time offender and life in prison for a repeat offender. |
