Musharraf handed death sentence in high treason case

This is the first time in Pakistain's history that a military chief has been declared guilty of high treason and handed a death sentence. The verdict was split 2-1.

Article 6 of the Constitution says: "Any person who abrogates or subverts or suspends or hold in abeyance, or attempts or conspires to abrogate or subvert or suspend or hold in abeyance the Constitution by use of force or show force or by any other unconstitutional means shall be guilty of high treason."

The punishment for high treason is death or lifetime imprisonment, according to the High Treason (Punishment) Act, 1973.

High Court Chief Justice Waqar Ahmad Seth and comprising Justice Nazar Akbar of the Sindh High Court (SHC) and Justice Shahid Karim of the LHC ‐ announced the verdict in the long-drawn high treason case against Musharraf after hearing final arguments today. A detailed verdict will be issued in 48 hours.

The former military chief is currently in Dubai in the United Arab Emirates. He was admitted to a hospital following deterioration of his health earlier this month. In a video statement from his hospital bed, he called the treason case "absolutely baseless". "I have served my country for 10 years. I have fought for my country. This [treason] is the case in which I have not been heard and I have been victimised," he had stated.

His team can appeal today's verdict in the Supreme Court. If the top court upholds the special court's verdict, the president possesses the constitutional authority under Article 45 to pardon a death row defendant.

#5  He killed Mrs Bhutto, destroyed hundreds of careers and families of men just doing their jobs. He invited the taliban into Balochistan, established Al-qaeda camps in the Sistan region and ordered the deaths of thousands of poor tribals. Murdered judges, lawyers and activists, no action could be taken against Perv's muscle for fear of liquidation.

The atrocities under him and his aide Tariq Aziz were left out by major networks because the BBC was turning pro-pakistan back then. No one got to know about his crimes, but the judiciary knew and they remembered. This only means that as democracy tries to assert itself in the 'Stain, the judiciary is trying their limits.

Not sure whether their military babus can work things Musharraf style to save him under the gaze of global watchdogs. Ideally it should deter them, but the watchdogs themselves seem to be corrupt as hell. Either way, he's going to get his punishment and suffer to death.

#4  If they punish Perv, then the next time they have a coup the General-in-Charge will have to remain dictator until he dies in office, one way or the other. It'll be a one way street.

If they don't punish Perv, then another coup is assured.

With this compromise, Perv (kind of the best of a poor lot of dictators) is "punished," but he's pit of the country, so no actual firing squad is involved. ISPR sez he can never be a traitor, leaving the door kinda sorta open for future dictators, and the attorney general calling the decision "void" sez the current govt's on the side of the military that
