VA Dems Threaten to Call out the NG over Gun Control
2019-12-15
via Bongino Report
[WashingtonExaminer] Democratic lawmakers on Capitol Hill say local police who do not enforce gun control measures likely to pass in Virginia should face prosecution and even threats of the National Guard.
Didn't take long for the mask to come off
After November's Virginia Legislature elections that led to Democrats taking control of both chambers, the gun control legislation proposed by some Democrats moved forward, including universal background checks, an "assault weapons" ban, and a red flag law.

Legal firearm owners in the state, however, joined with their sheriffs to form Second Amendment sanctuary counties, which declare the authorities in these municipalities uphold the Second Amendment in the face of any gun control measure passed by Richmond.

Over 75 counties in Virginia have so far adopted such Second Amendment sanctuary resolutions in the commonwealth, the latest being Spotsylvania County. The board of supervisors voted unanimously to approve a resolution declaring that county police will not enforce state-level gun laws that violate Second Amendment rights.

Virginia Democratic officials, however, already say local law enforcement supporting these resolutions will face consequences if they do not carry out any law the state Legislature passes.

"I would hope they either resign in good conscience, because they cannot uphold the law which they are sworn to uphold, or they're prosecuted for failure to fulfill their oath," Democratic Virginia Rep. Gerry Connolly told the Washington Examiner of local county police who may refuse to enforce future gun control measures. "The law is the law. If that becomes the law, you don't have a choice, not if you're a sworn officer of the law."
Unless of course you're ignoring Federal immigration laws

#6  P2K is correct. I was one of the senior operations officers for the Adjutant General of California during the LA riots. In state active duty our troops conducted a wide range of direct and indirect law enforcement missions authorized my the Military and Veterans Code of CA. As soo. As the President federalize the for e and brought in federal troops Posse Commitatus drastically limited our ops to suppport.

#5  The Guard can be used to keep the peace (get things settled down after a riot or natural disaster, for instance), NOT to enforce the law - see also the Posse Comitatus Act.

Sorry Mike, it does not apply to the NG when in state service. It only effects federal personnel. When the guard is federalized, then it applies. However, even the feds can be used in instances of insurrection.

Since the Aholes have no history, when good o'1861 came around even the federal military fractured. I suspect of the guard if they force the issue.

...HahahahahahahahahahahahahahahahahahahNO.

The legislators who are threatening this have proved once and for all that they've never read a single damned law, or for that matter, the Constitution.

1)The Guard can be used to keep the peace (get things settled down after a riot or natural disaster, for instance), NOT to enforce the law - see also the Posse Comitatus Act. The VA Guard leadership would be on solid, unshakable legal ground to refuse any order from Richmond to go out and confiscate weapons. But let's say, for the sake of argument, that someone in the VANG completely blew an integrity gasket and said, go do it. Well, then....

2) Good luck getting all 7500 people in the VANG to go along with it. The tin-plated gods in Richmond forget that Virgina is a lot more than a couple of counties in the north. That state is a LOT more red than they think, and once you get out of NoVa and the coast, it's a different world...and that's the world most of the VANG comes from.
3) It's entirely likely that for all its combat ferocity - and the VANG is damned good, as befits the heirs of Lee's legions - they will go all Gomer Pyle when it comes to finding 'illegal' weapons. But
4) is the big one - if somehow, all the other safeguards fail, with one stroke of a pen DJT can Federalize the VANG...which immediately takes them away from Northam's control. Game, set and match, because at that point anybody in the VANG chain of command who authorized this happy horsesh!t is now liable to the UCMJ and they can at the very least look forward to dismissal and disgrace, because they (and a couple of generations of US military forces) have been taught as a matter of law that 'following orders' is not an excuse for breaking the law.

#3  The last time Virginia thought it could nullify the federal Constitution didn't end well. Oh, and that was a 'popular' action with the legislature and governor as well.

#2  I hope the Democratic leadership in Virginia hurries up with its anti-second amendment plans. It will turn Virginia red in time for the 2020 election.

#1  "Sanctuary Cities."
Calling out the NG to defy the Constitution.

Since when did John Calhoun's theory of nullification gain so much credibility with our woke brethren?
