| #1 "All seven of the judges who voted to deny the emergency stay were appointed by Republicans—including two chosen by President Trump—while the four who voted in the minority were named by Democrats." Current make up of the 9th Circuit is 12 R appointees and 16 D appointees. There is 1 current vacancy (Replacing a R appointee) and 2 future vacancies announced (both R appointees). Filling all 3 will have the court at a 13/16 split. |
