The Obama appointee at the heart of the Oregon stand off |
2016-01-05 |
A lot of inside baseball stuff about an Obama appointee to a US attorney position because Obama wanted a woman in charge. Spoiler alert: Zipper failure caused her to step down. [Conservative Treehouse] The media are focused on the “Bundy Militia” angle to the standoff in Burns Oregon, where Aamon Bundy and brothers have taken over a Malheur Wildlife Refuge Headquarters to draw attention to the plight of the Hammond family. However, a little research (HatTip NeverTooLate) into the original legal battle reveals a rather startling update. The initial, and regarded by many as overreaching, federal prosecution resulted in a federal court judge Michael Hogan assigning a 3-month sentence and 1-year sentence for Dwight Lincoln Hammond Jr (73) and his son, Steven Dwight Hammond (46) respectively. Even federal Judge Hogan stated the prosecution under “terrorism statutes” itself was an overreach and he refused to assign ridiculously high sentences for behavior that almost every rancher has conducted for generations. Those sentences were fulfilled by the father an son duo in 2013 with Steven Hammond exiting prison in January 2014. However, it was a decision by the U.S Attorney for the State of Oregon, Amanda Marshall, who called for an appeal to the original sentencing: The rest of the story at the link |

#3 Bundy and his friends might do better raising funds for an appeal. |

#2 How do you appeal a sentence? Sounds like double-jeopardy to me. |

#1 If the Federal Government put people in prison for land management after that EPA spill, I see absolutely no reason. Right cause, wrong people to deliver the message. Commute the "Arsonist" sentence, ask the occupiers if they plan to pay for all the management of the whole properties they want to re-claim from the government, and then charge the bundy faction with improper use of a weight room. Send it home. Drop it now, walk away. The "teaching point" has been made. |
