Karma About to Bite Hillary Through State Dept Probe
[Victory Girls] Karma may be about to bite Hillary Clinton’s wide, umm, tuchas, thanks to a State Department probe. That probe surrounds ‐ you guessed it ‐ some emails sent to the unsecured server that she kept in her basement.

According to the Washington Post, State Department investigators have been contacting some 130 senior officials whose emails ended up in that server. They sent them years ago, so why does State need them now?

It’s because those emails have been retroactively reclassified and now pose potential security violations. Some contain information so sensitive that they should’ve been sent only on State Department classified servers. But Hillary Clinton obviously thought, as Secretary of State, that she was above silly things like maintaining security.

Naturally some Democrats are crying foul. One former official said that this is how Republicans "keep the Clinton email issue alive," and was a way to "tarnish a whole bunch of Democratic foreign policy people."

Judge tells DOJ to charge McCabe or drop investigation
[The Hill] A judge told federal prosecutors on Monday that they needed to charge former acting FBI Director Andrew McCabe or stop investigating whether he lied to authorities.

Judge Reggie B. Walton said at a hearing that if prosecutors don't make a decision by Nov. 15, he would order the Justice Department to release internal FBI documents connected to McCabe's ouster, according to a transcript of the hearing.

"If the government has not made a call I'm going to make a ruling," he said. "This is just dragging too long. And those who have to make these hard decisions need to do it. And if they don't, I'm going to start ordering the release of information."

"I will not condone further delay," added Walton, a George W. Bush appointee who once presided over the Foreign Intelligence Surveillance Court.

"You all have got to cut and make your decision. It’s not a hard decision, and I think it needs to be made. If it’s not made, I’m going to start ordering the release of information because I think our society, our public does have a right to know what’s going on," he continued.

The comments came after Department of Justice (DOJ) lawyers spoke to Walton about the Freedom of Information Act (FOIA) lawsuit for documents on the FBI's probe of McCabe, according to The Washington Post. The government has reportedly said it would not release the documents due to their potential effect on law enforcement actions.

#12  This incident is being minimized in the leftist / national press (but I repeat myself) as 'minor and routine'. He apparently had a heart attack and had two stents put in for ruptured / weak walled arteries. This is precisely what happened to me last year. While it may now be 'routine', I don't see it as 'minor'.

[NRO] Remember last month when San Francisco’s Board of Supervisors passed a resolution declaring the National Rifle Association a domestic terrorist organization and ordered city employees to "take every reasonable step to limit" business interactions with the NRA and its supporters? The one that our David French labeled "a retaliatory public attack on constitutionally protected speech"?

The NRA sued, and lo and behold, San Francisco is backing down, before the suit even went to court.
Great. Now sue 'em for libel
In a formal memo to city officials, San Francisco mayor London Breed declared that "no [municipal] department will take steps to restrict any contractor from doing business with the NRA or to restrict City contracting opportunities for any business that has any relationship with the NRA."

The memo declares, "resolutions making policy statements do not impose duties on City departments, change any of the City’s existing laws or policies, or control City departments’ exercise of discretion."

"Through these actions and our public advocacy, we hope the message is now clear," NRA CEO and executive vice president Wayne LaPierre said in a released statement. "The NRA will always fight to protect our members and the constitutional freedoms in which they believe."

"The memo serves as a clear concession and a well-deserved win for the First and Second Amendments of the United States Constitution," says William A. Brewer III, partner at Brewer, Attorneys & Counselors and counsel for the NRA. "It is unfortunate that in today’s polarized times, some elected officials would rather silence opposing arguments than engage in good-faith debate. The NRA ‐ America’s oldest civil rights organization ‐ won’t stand for that."

The NRA is challenging a similar law passed by the Los Angeles city council that requiring city contractors to disclose any ties they have to the gun-rights group. Back in August, a federal judge denied a request by the city to dismiss the suit.
Sue them into bankruptcy.

Ukraine probes ex-prosecutor named in Trump scandal
[AlAhram] Ukraine on Tuesday opened a probe into possible abuse of power by Yuriy Lutsenko, the former prosecutor who figures in the whistleblower complaint against US President Donald Trump

Lutsenko, who was fired from his post of prosecutor general in August, is suspected of "abetting illegal gambling business," the spokeswoman of Ukraine's State Bureau of Investigations Anzhelika Ivanova told AFP.

The investigation was launched at the request of Ukrainian politicians, she said, without elaborating on the exact allegations.

Ukrainian news agency Interfax reported that the probe started after a statement given by David Arakhamia, a senior MP with the party of President Volodymyr Zelensky.

The statement has not been made public but Lutsenko, who is currently in London, denied the allegations.

"One must have great imagination to accuse me of what Mr. Arakhamia is saying," Lutsenko said on his Facebook page.

Last week Lutsenko wrote that the complaint against him for abuse of power made by a security services employee was "manipulative and untrue".

Meanwhile the US whistleblower complaint published last week claimed Trump attempted to advance his personal interest in a call with Zelensky in July, during which he praised Lutsenko as a good prosecutor and suggested he keep his position.

Lutsenko has said that he met with Trump's lawyer Rudi Giuliani over the matter, but that ultimately there was no reason to investigate Biden and his son under Ukrainian law.

The whistleblower complaint says earlier this year Lutsenko had made allegations regarding activities of Biden's family in Ukraine, and claimed that former US ambassador Marie Yovanovich obstructed Ukrainian law enforcement.

The claims have been echoed by Trump's allies, and Yovanovich was recalled from her post in May. She has now been summoned to be questioned by US congressional committees in the impeachment inquiry against Trump.

Ukraine Isn't The Only Country Hunter Biden Had Extremely Sketchy Dealings With
[RedState] Given his drug addiction and getting kicked out of the military, I could be just talking about his dealings in the United States, but Hunter Biden gets around.

Somehow a guy with no experience doing anything has managed to land several lucrative gigs in foreign countries, making more in a month than most people make in a year. I wonder what could possibly be behind the stroke of luck the drug addled, womanizing Hunter Biden found himself on over the past five years?

Although most of the smoke surrounding the former VP’s son has revolved around getting paid $50,000 a month by a corrupt Ukrainian oil company, he’s also found himself tied up in dealings with the Chinese. Ironically, it looks like a mistaken phone call to the wrong Biden family member exposed the whole thing.

Ex-Attorney General Eric Holder butt hurt with Bill Barr Investigation of IC
[MAIL] The former-Attorney General Eric Holder has questioned whether Bill Barr's investigation into alleged misconduct by US agencies at the start of the Russia probe can possibly be impartial when it was ordered by Donald Trump.

Holder, 68, who served during Barack Obama's presidency, said the current attorney general risked 'paying a price' and sacrificing his credibility on Tuesday.

Barr assigned U.S. Attorney John Durham to pursue a probe into whether there was misconduct by the intelligence community at the beginning of the Russia investigation.

Speaking at an event in Fairfax, Virginia, Holder explained that Barr needed to be 'a little more sensitive to the appearance' given by having Trump involved.

He told Fox News: 'To see how the president is now involved to help the attorney general in that effort gives me pause.'

Federal judge blocks California law requiring Trump to release tax returns to appear on ballot
The Constitution provides all the requirements, not tin-pot Democrat state dictators
[CNN via 10News] A federal judge in California blocked a state law that requires candidates for president to disclose income tax returns before their names can appear on the state's primary ballot.

The ruling is a win for President Donald Trump, who is resisting efforts to turn over his tax returns in a battle largely playing out in the courts.
US District Judge Morrison C. England Jr. of the Eastern District of California on Tuesday wrote "while this Court understands and empathizes with the motivations that prompted California" to pass the law, "the Act's provisions likely violate the Constitution and the laws of the United States." England noted that it is not the court's role "to decide whether a tax return disclosure requirement is good policy or makes political sense."

The judge said the law would set a dangerous precedent and become a slippery slope for other kinds of disclosures. He also said it presents a "troubling minefield " that would permit a state to make its own demands.

Last month -- ruling from the bench -- the judge had signaled he was inclined to rule in favor of the President.

Ukraine's leader: Trump didn't use US military aid as lever
KYIV, Ukraine (AP) ‐ Ukraine’s president said Tuesday that no one explained to him why millions of dollars in U.S. military aid to his country was delayed, dismissing suggestions that President Donald Trump froze the funding to pressure Ukraine to investigate Democratic rival Joe Biden.

President Volodymyr Zelenskiy is struggling to distance himself from U.S. politics ‐ and to contain the damage to Ukraine and his own reputation from a July phone conversation with Trump that unleashed a congressional impeachment inquiry.

"It is impossible to put pressure on me," he told reporters Tuesday. "Many people try to influence me," he said, but "I am the president of independent Ukraine."

Zelenskiy said that in discussions with Trump, he repeatedly stressed the importance of U.S. military aid to help Ukraine battle Russian-backed separatists.

Facebook reverses takedown of 'Elizabeth Warren Wiki' page exposing her Cherokee and other controversies
[Legal Insurrection] The Facebook page went live in February 2013, at the same time that ElizabethWarrenWiki.org went live.

The takedown was based on the plainly false claim that the Facebook page violated Facebook’s "Impersonation" policy:

We clearly do not violate this policy. The Wiki page does not purport to "impersonate" Warren ‐ the title of the page specifically has "Wiki" in it indicating it is not purporting to be Elizabeth Warren. Beyond the title, the "About" section makes the following disclosures (which are what the Facebook policy says should be done ‐ see above)...
Mission
Elizabeth Warren Wiki's mission is to be the most comprehensive repository of information and links regarding Elizabeth Warren, United States Senator from the Commonwealth of Massachusetts. This Wiki site is not affiliated with Senator Warren or her campaign.

So the Elizabeth Warren Wiki Facebook Page in its title relates to Elizabeth Warren Wiki, which has been in existence since February 2013, does not purport to be Elizabeth Warren, and just so there is no confusion, has disclosures of the type Facebook specifically says should be made.

Nonetheless, the page was taken down without warning based on a false claim that it violated Facebook’s Impersonation policy.

The takedown generated substantial media and social media attention.

Giuliani tonight on Fox said he is going to do just that.

Congress critters can say anything they want to on the House floor. But when they slander the President and attempt to obstruct the President or anyone else in an excessive manner, away from the floor, they can and should be brought before a civil court.

He seemed to say that as Trump's personal attorney he is going to do just that to certain individuals.

#11  EC, that certainly is the Socialists position in this case, pound the table. They've been doing it since Nov 2016.

And I say Socialists, because their behavior and acts show that in the end they plan to have a one party system. About as democratic as the old "Peoples Democratic Republic of..." of Eastern Europe.

#16  So now they are saying that governments are booking blocks of rooms at his hotels, paying for them but not staying there. They are calling it a mystery and a payoff for Trump. Funny no one ever raised an eye about the giant payoffs using book deals. Obama had book after book deal to the tune of tens of million for each book, all while in office. It was a series of payoffs, and no one batted an eye.
