#1 I'm no lawyer, but it seems public safety considerations would more than override any theoretically hypothetical establishment clause arguments the Phelpsies make - unless the Ninth Ciruit's hearing the case.

#4 He's not crossing the line on state and religion, he's specifically dissociating the city and its good citizens from a religion. Seems okay to me.
