  • Smollett is due in bond court on at 1.30pm CT on Thursday

  • He is charged with filing a false police report, a Class 4 felony

  • Police say that he hoaxed a hate crime assault on himself on January 29

  • Cook County State's Attorney approved charges after grand jury indicted

  • Brothers Olabinjo 'Ola' Osundairo, 27, and Abimbola 'Abel' Osundairo, 25 were earlier seen entering grand jury

  • Video of them buying ski masks and red hat day before the attack has emerged

  • Smollett, who has hired a team of lawyers, denies that he made up his story

  • His attorneys say he 'enjoys the presumption of innocence' in the case

  • Charges carry a maximum sentence of three years and a fine of up to $25,000

  • FBI is also still investigating hateful letter that Smollett said he received
Smollett being named as a suspect on Wednesday after it emerged he once lied to police by pretending to be his younger brother. In 2007, when he was pulled over for a DUI, Smollett told the officers that he was his younger brother Jake.

The actor, who was 25 at the time, pleaded no contest to providing police with false information, driving while intoxicated and driving without a valid license. He was sentenced to two years probation and had to complete an alcohol awareness and education program.

#10  there is no 'typical' sentence as the crime of sending threatening letters through the USPS mail is relatively uncommon and because most such cases that are solved are settled via a plea agreement

But Juicy may need more than an apology to get out from under the federal crime of using the mail for naughty deeds.

#2  Smollett going national with this aggravates it even more. For that, there should be a federal hate crime investigation. However, the reality is that, if found to be hoax, he will not be aggressively prosecuted. If he is even charged, he will most likely receive some watered-down prosecution, pay a fine and be allowed to move on—therefore the lack of deterrence encourages others to perpetrate subsequent hoaxes.
