#7 A workaround would be to have an ICE agent, or a local LEO, or a state-activated Guardsman, embedded in the regular military units, who would then serve as the non-federal-military authority whom the active duty military is "assisting". |

#5 In the National Guard, it depends on whether you are Title 10 activated or not. Posse Comitatus applies when its a Title 10 (Federal) activation. But dual or State activation PC does not apply, and Guard can do law enforcement - which is what happened during Katrina, with out of state Guard units carrying live rounds and patrolling for looters. But Posse Comitatus only applies to enforcement of "Domestic" laws, so, arguably, border security is "international", not domestic. There is precedent: Exceptions exist for the Enforcement of federal law at the discretion of the President of the United States, such as with the 101st Airborne Division by President Dwight D. Eisenhower to integrate Little Rock Central High School in 1957, and for ISR activity for the DEA, DHS and counterterr activity. |

#2 Protecting the sovereignty of the US and and specifically CONUS is the first responsibility of the military. You may not like the job, but fretting away resources elsewhere while ignoring this one undermines your rationale to exist. |
