| A disabled access attorney who has sued entire towns over alleged access violations has been rebuked by a San Diego federal court judge for his conduct in a recent case, told to pay legal fees and take ethics classes. YES! San Diego attorney Theodore Pinnock, who has cerebral palsy and uses a wheelchair, was ordered to pay more than $15,000 in legal fees incurred by a business owner who was sued over alleged access violations at a convenience store that wasn't even open for business. It's a start U.S. District Judge Jeffrey T. Miller also imposed sanctions against Pinnock, ordering the attorney to complete four hours of ethics and professional responsibility training approved by the California State bar. ahhh let him foment and smolder In his order entered today, Miller found that Pinnock & Wakefield should be sanctioned for failing to conduct a "reasonable and competent inquiry." But the judge declined to pay defense attorneys their requested $38,514 in legal fees, which the judge found to be "unreasonable" and cut the award to $15,213. well next time, we can dream uknow! In an order earlier this year, Judge Miller of the Southern District cited The Bee's series and his concerns that Pinnock's conduct would undermine the noble intentions of the ADA. more at linky. |

| #4 SPoD: Disagree; while there are some bad eggs, don't lump all the laywers in the same basket. #1 son has to support his dear old Mom after I go to my reward ( probably a swim call in Gaza if I don't change my ways) and she has expensive habits...... |

| #2 A start on cleaning up the legal "profession" up would be to hang 8 out of 10 of them at random starting with the lobbyists, politicians and the politically connected. Yea I am bitter so feel free to ignore me. Our nation would be better off without lawyers. We are now a nation by lawyers for the lawyers. Regular persons are thrid class citizens after the lawyers and lawyer created coporations. |
